عنوان فارسی رهیافت مؤلف‌گرا در تفسیر قانون اساسی جمهوری اسلامی ایران
چکیده فارسی مقاله در تعیین معنای متون – از جمله متون حقوقی و قانون اساسی- سه رهیافت عمده‏ی مؤلف‏گرا، متن‏گرا و مفسرگرا قابل شناسایی‏اند. در این میان، مؤلف‏گرایی دیدگاهی است که قرن‏ها در اغلب نظام‏های حقوقی، نظریه‏ی مسلط تفسیری بوده و همچنان نیز در بسیاری از نظام‏های حقوقی – مانند ایران و آمریکا- کم‏وبیش مورد توجه است. معنای قانون اساسی در نظریه‏ی مؤلف‏گرا از مقاصد و منویات قانونگذار برمی‏خیزد. این نظریه در اصول فقه شیعه و همین‏طور نگاه اعضای شورای نگهبان به‏عنوان نظریه‏ی صحیح و رسمی تفسیر پذیرفته شده است. شاخه‏های گوناگونی چون قصدگرایی، غایت‏گرایی و تسلیم‏گرایی همه در اعتبار دادن به مقصود مؤلف مشترک‏اند و در مقام ارزیابی، کم‏و‏بیش نقاط مثبت و منفی این نظریه را دارند. پژوهش حاضر با بررسی شماری از منابع حقوق اساسی و نظریه‏های اندیشمندان علم اصول و فلسفه‏ی حقوق در پی معرفی دیدگاه تفسیری مؤلف‏گرا در تفسیر قانون اساسی با بیان گوشه‏ای از تاریخچه، ماهیت و اقسام آن و تأثیری است که بر نظام حقوقی کشور گذاشته است. ارزیابی این مقدمات، ایرادات جدی زبانی و غیرزبانی نظریه‏ی مؤلف‏محور را روشن می‏سازد.

عنوان انگلیسی The Author-Oriented Approach in Interpreting the Constitution of the Islamic Republic of Iran
چکیده انگلیسی مقاله Three main approaches would be recognized semantically regarding the legal texts and the Constitution: the author-oriented, text-oriented and interpretor-oriented approaches. The author-oriented approach has been the dominant interpretive theory of the most legal systems and to some extent under the attention of many countries like Iran and America. The meaning of the Constitution in the author-oriented theory arises from the intents of the legislator. This theory is accepted as the right and formal theory of interpretation in Shi'a Usul al-Figh (Principles of Shi'a jurisprudence) and also the viewpoints of the Guardian Council. Various branches like Intentionalism and Purposivism are all common in validating the intents of the author and while being evalutaed are to some extent the same. The present research examining some Constitutional law sources and the theories of Usul scholars and philosophy of law is to present the author-oriented interpretive viewpoint in Constitutional interpretation while shortly explaining the history, nature, its types and impression on the legal system of Iran. The evaluation of these preliminaries will elucidate the linguistic and non-linguistic problems of author-orinted theory.
