عنوان فارسی خاستگاه‌های اصول عملیه در متون فریقین
چکیده فارسی مقاله در پژوهش‌های فقهی و اصولی معاصر کاوش در خاستگاه‌های مسائل و پی‌جویی ریشه‌های تاریخی مفاهیم و آراء، به تدریج بخشی از مبادی تصوری و تصدیقی را به خود اختصاص داده است. روشی که بی‌تردید فهم عمیق موضوع و مسأله تنها در پرتو آن میسور خواهد بود. ارائه پژوهشی دقیق در مباحث اصول عملیه نیز از این قاعده مستثنا نیست. مقاله حاضر به تحقیق در خاستگاه‌های تاریخی مباحث عام اصول عملیه پرداخته و تلاش کرده با مطالعه استقرائی همزمان در متون سنی و شیعی متقدم به پرسش‎هایی چون نحوه ورود این مفاهیم در دیوان مباحث اصولی و فقه استدلالی، ویژگی‌های مشترک، رویکرد متقدمان به اصول عملیه، ترتیب طرح این اصول، جایگاه و رابطه‌ی آن‌ها با یکدیگر و نظم موجود در میان آن‌ها پاسخ گوید.حاصل این تحقیق این است که اصول عملیه گرچه مبانی استواری در آموزه‌های ائمه (ع) دارد لیکن در عرصه تدوین، خاستگاه‌های این اصول در متون اصول و فقه استدلالی اهل تسنن سراغ گرفته می‌شود. دیگر اینکه اصول عملیه در رویکرد متقدمان شیعه و سنی دارای دو ویژگی کلی است: نخست آنکه قطعی است و دیگر این که نسبت به امارات در رتبه پایین‌تر قرار دارد.

چکیده انگلیسی مقاله In contemporary researches about the issues concerning fiqh and uṣūl (jurisprudence and the principles of jurisprudence), exploring the origins and historical traces of concepts and views has gradually become a part of their conceptual and assertoric principles; the method that definitely would be the only way to have a profound understanding of an issue. Likewise, it is necessary to apply this method to have an in-depth research regarding uṣūl ‘amalīyah (practical principles). The paper explores the historical origins of general matters of uṣūl ‘amalīyah and, through an inductive study in earlier Shī‘a and Sunnī texts, intends to answer the questions like: the way these concepts entered in demonstrative jurisprudence and uṣūl discourses, their common characteristics, the earlier scholars’ approach to uṣūl ‘amalīyah, application order of these principles, their position, their relation with each other, and their internal order. The research concludes that uṣūl ‘amalīyah, however, have firm bases in Imams’ (A.S.) teachings, but as regards compiling, their origins trace back to Sunni demonstrative jurisprudence and uṣūl texts. From earlier Shī‘a and Sunnī scholars’ point of view, uṣūl ‘amalīyah have two general characteristics: first, these principles are definite, and second, that they come into effect after amārāt (denotations).
