عنوان فارسی نقش مقدمه‌ی قانون اساسی در تفسیر اصول و شناخت اهداف و رسالت‌های قانون اساسی جمهوری اسلامی ایران
چکیده فارسی مقاله در اسناد قانونی، مقدمه، متکفل معرفی موضوع، زمینه‌های شکل‌گیری، رسالت و هدف آن سند است. مقدمه‌ی قانون اساسی جمهوری اسلامی ایران نیز با آنکه به این موارد اشاره کرده، عمده‌ی نگاه‌ها به این متن، ناظر بر ارزش تاریخی آن بوده است و کمتر به ارزش حقوقی آن و تأثیر بسزای آن در تفسیر مقرون به صواب از اصول قانون اساسی، توجه می‌شود. مدعای این مقاله آن است که از جمله ملزومات ارائه‌ی تفسیر صحیح از یک سند قانونی، توجه به مقدمه‌ی آن است. قانون اساسی جمهوری اسلامی ایران نیز از این قاعده کلی مستثنا نبوده و برای ارائه‌ی تفسیر صحیح از آن ضروری است به مقدمه‌ی آن، که بیانگر اصول حاکم بر مفاد مندرج در متن قانون اساسی و به‌مثابه‌ی ارکان و پایه‌های آن است، توجه شود.

چکیده انگلیسی مقاله In the legal documents, Introduction is responsible for introducing the subject, formation context, mission and purpose of the document. Although these components are mentioned in the preamble of the constitution of the Islamic Republic of Iran, Most approaches to this preamble, are Focused on its historical value and less attention is paid to its legal worth and tremendous impact on the proper interpretation of the constitution principles. The claim of this article is that one of the requirements of correct interpretation of a legal document is attention to its preamble. The Constitution of the Islamic Republic of Iran is not an exception and in order to interpret it correctly it is essential to pay attention to its preamble which contains the principles governing the provisions of the constitution and is as a pillar and foundation of constitution.
