عنوان فارسی اصل الزام به ارائه‌ی دلایل تصمیمات اداری در پرتو مفهوم اداره‌ی خوب: مطالعه‌ی تطبیقی نظام حقوقی ایران و اتحادیه‌ی اروپا
چکیده فارسی مقاله اصل الزام به ارائه‌ی دلایل تصمیمات اداری، یکی از اصول مدرن حقوق اداری است که در نظام‌های حقوقی مطرح دنیا به‌ رسمیت شناخته شده است. در این مقاله به تبیین محدوده و مبانی این اصل و سپس تطبیق و مقایسه‌ی جایگاه آن در نظام حقوقی اتحادیه‌ی اروپا و ایران به‌منظور استفاده از تجربیات این سازمان منطقه‌ای در راستای اشراف بر ضعف‌ها و قوت‌های قوانین، مقررات و رویه‌ی قضایی ایران در این زمینه پرداخته می‌شود. نتیجه‌ی بررسی‌های صورت‌گرفته در این دو نظام حقوقی چنین می‌نماید که اصل الزام به ارائه‌ی دلایل تصمیمات اداری در اتحادیه‌ی اروپا یکی از شاخصه‌های اداره‌ی خوب بوده و مقامات اداری مکلف به بیان ادله و مبانی تصمیمات خود هستند. در نظام حقوقی ایران نیز این اصل، در برخی قوانین و مقررات و همچنین آرای قضایی دیوان عدالت اداری مطرح شده و به‌صورت موردی مقامات اداری به بیان دلایل تصمیمات خویش مکلف شده‌اند. اما لازم است این موضوع بر کلیه‌ی اقدام‌ها و تصمیمات اداری تعمیم یابد.

چکیده انگلیسی مقاله The principle of obligation to state reasons of the Administrative decisions is one of the modern principles of administrative law that is recognized in the important legal systems. The object of this paper is to determine the scope and Foundations of the Principle and Then, to compare its place in Europe and Iran's legal system in order to use the experiences of the international organization and to understand the strengths and weaknesses of laws, regulations and precedent of Iran. Result of investigations carried out on the two legal systems shows that principle of Obligation to state reasons of the Administrative decisions is one of the characteristics of good administration and Government officials are obliged to state the reasons for their decisions. This principle have been mentioned in some of the laws and regulations and precedent of the legal system of Iran and some of the administrative officials are obliged to state their decisions’ reasons in some specific cases, But it should be extended to all administrative decisions.
