عنوان فارسی مبانی مسئولیت مدنی دولت در قبال آلودگی‌های زیست‌محیطی
چکیده فارسی مقاله اهمیت جبران مناسب خسارت‌های زیست‌محیطی اخیراً توجه بیشتر حقوقدانان را به خود معطوف داشته است. پیچیدگی‌های ماهیت خسارت‌های زیست‌محیطی و جبران آنها از طریق مبنایی مناسب می‌تواند از دلایل مهم اختلاف نظرهای حقوقی موجود برای جبران این زیان‌ها باشد. در این نوشتار با عنوان «مبانی مسئولیت مدنی دولت در قبال آلودگی‌های زیست‌محیطی»، به شیوه‌ی تحلیلی در پی پاسخ به این پرسش‌ها هستیم که آیا دولت نیز مانند سایر اشخاص تنها زمانی مسئول جبران خسارت‌های زیست‌محیطی است که بین فعل یا ترک فعل او و ورود زیان رابطه‌ی سببیت برقرار باشد؟ و اینکه استفاده از کدام مبنا برای جبران آلودگی‌های زیست‌محیطی توسط دولت مناسب‌تر است؟ از آنجا که دولت حافظ منافع عموم است و مردم نیز به موجب قوانین و مقررات مختلف حق برخورداری از محیط زیست سالم را دارند، در شرایطی جبران زیان‌هایی که منتسب به دولت نیست، ضروری به‌نظر می‌رسد. زمانی‌که آلودگی‌های زیست‌محیطی منتسب به دولت باشد، در نظر گرفتن مسئولیت محض برای دولت در جبران خسارت، موجب سهولت در دادرسی و جبران بهتر خسارت‌های زیست‌محیطی می‌شود.

چکیده انگلیسی مقاله Recently the importance of proper compensation of the environmental damages has attracted the attention of many lawyers. The complexity of nature of the environmental damages and the compensation of them by using an appropriate basis can be important reasons of the differences in legal opinions about compensating these losses. Thus, in this study with the title of "The bases of the government’s civil liability against the environmental pollutions", an analytical method is chosen to answer these questions that whether the government, like the others, is responsible for compensation of the environmental pollution just when there is a causal connection between the act or omission and the incurring of loss, and which basis is better to compensate the environmental damages by the government? Since the government is the keeper of public interests and people based on various laws and regulations have the right to have a healthy environment, in some situations, it is necessary for the government to compensate the damages which even are not attributable to it. When the environmental pollution is caused by the government, considering strict liability for it would facilitate the justice and compensation of loss.
