عنوان فارسی بررسی ماهیت نظرات شورای نگهبان
چکیده فارسی مقاله با توجه به نقش ویژه‌ی شورای نگهبان در نظام جمهوری اسلامی ایران، فهم صحیح از ماهیت کارکرد و نظرات آن شورا، گام مهمی در تبیین ویژگی‌ها و انتظارات از آن نهاد در ایفای وظایف قانونی‌اش است و به رفع نقص‌ها و کاستی‌ها و تلاش در راستای بهبود عملکردهای آن نهاد خواهد انجامید. با بررسی ماهیت کارکرد شورای نگهبان در قالب تحقیقات تحلیلی – اکتشافی مشخص می‌شود که نظرات شورا در مواردی که کارکرد اصلی شورا تطبیق موضوع با حکم است، قضایی است، و در مواردی که به ارائه‌ی نظرات تفسیری و مشورتی می‌پردازد، کارکرد آن مبتنی بر نوع خاصی از کارویژه‌ی تفسیری است. در خصوص استعلامات دیوان عدالت اداری نیز کارکرد فقهای شورای نگهبان حاکی از نوعی عمل کارشناسی است. همچنین صلاحیت‌های عام شورای نگهبان در امر انتخابات در موارد نادری بیانگر کارکرد سیاسی آن شوراست.

چکیده انگلیسی مقاله Given the special role of the Guardian Council in the Islamic republic of Iran, a correct understanding of the nature of the function and decisions of this council is an important step in explaining the characteristics of this institution and what is expected from this institution in its legal duties, and leads to remove deficiencies and efforts to improve its functions will be established. Through examining the nature of the function of the Council based on analytical - exploring research will be determined that the decisions of the Council in all cases that the main function is adapting subject to statute is judicial, and in the cases that the council intends to provide advisory and interpretive opinions it's function is based on a special type of interpretive functions. About the inquiries of Administrative Justice Court it seems that Guardian Council's Juris consults, work as experts. Also, the general jurisdiction of Guardian Council in the elections in rare cases represents a political function of the Council.
