عنوان فارسی وظایف و اختیارات دادگاه عالی فدرال جمهوری عراق
چکیده فارسی مقاله قانون اساسی متضمن عالی‌ترین و اساسی‌ترین قواعد و اصولی است که مبین ساختارها، روندها، سیاست‌ها و ارزش‌های یک جامعه است و به‌واسطه‌ی آن قدرت سیاسی مستقر می‌شود، اجرا می‌گردد و انتقال می‌یابد. این مسئله موجب شده است که صیانت از قانون اساسی، به‌عنوان میثاق ملی و سند حقوقی سیاسی کشور، به امری کاملاً مهم و ضروری تبدیل گردد و در همه‌ی نظام‌های حقوقی نیز تدابیری برای آن اندیشیده شود. «دادگاه عالی فدرال» نیز نهاد نوپای نظام حقوقی جمهوری عراق است که متعاقب تحولات اخیر این کشور و نیز تدوین قانون اساسی جدید آن در سال 2005، با گستره‌ی وسیعی از وظایف و اختیارات برای نیل به این اهداف تأسیس شده است. این نوشتار ضمن بررسی اجمالی نظام قانون اساسی جمهوری عراق، به تبیین صلاحیت‌ها و کار‌ویژه‌های نهاد مزبور می‌پردازد.

چکیده انگلیسی مقاله The Constitution contains the highest and the most fundamental rules and principles clarifying the structures, policies and values of a society in which the political power is settled, fulfilled and transferred. This issue requires the consistence of the laws with the Constitution, as the national covenant and legal document of the country, to be an absolutely important and essential matter and therefore in all legal systems pursuant to this purpose, there have been measures considered. The Federal Supreme Court (The FSC) is also the fledgling institution of the Iraqi legal system that has been established according to the new Constitution (2005) and following the recent developments of Iraq with a vast scope of duties and powers to attain these objectives. This article while examining the system of Iraqi Constitution, verifies the functions and competences of the Federal Supreme Court.
