عنوان فارسی اخراج اتباع بیگانه در حقوق کیفری ایران
چکیده فارسی مقاله زمینه و هدف: بسط روابط بی نالمللی و نیز گسترش مسائل سیاسی و اجتماعی مختلف درجهان، موجب افزایش روابط مردم دنیا و ورود اتباع بیگانه به کشورهای مختلف از جمله ایرانگشته است که می تواند در مواردی زمینه ساز تعارض با منافع کشور میزبان و به وجود آورندهمسائل مختلف حقوقی باشد. بر این اساس هدف این پژوهش بررسی مسائل گوناگون حقوقی دررابطه با اخراج اتباع بیگانه از کشور ایران و چالش های مهم و اساسی مربوط به آن است.روش تحقیق: پژوهش حاضر بر اساس روش تحلیلی و بر پایه منابع کتابخان های نگاشته شدهاست.یافت هها و نتیجه گیری: از نظر حقوق بین الملل هیچ دولتی موظف به پذیرش اتباع بیگانه و یاموافقت با ادامه حضور آنان در قلمرو خویش نیست و می تواند هرگاه حضور فرد خارجی را درتضاد با منافع خویش دید، او را اخراج کند. اختیار دولت ها درای نباره به صورت مطلق و ناشیاز اصل حاکمیت دولت ها است ولیکن می توان از طریق بعضی اصول حقوق بین الملل مانندممنوعیت استفاده ناروا از حق اخراج و رعایت اصل حسن نیت و اصل منع اعاده پناهندگان بهتحدید اختیار دولت ها در اخراج بیگانگان پرداخت. ماهیت اخراج به این صورت است که وقتیمراجع دولتی یا قضایی تصمیم به آن م یگیرند، با اجبار فرد بیگانه به خروج از کشور همراهم یشود و اراده فرد در آن تأثیری ندارد. بحث اخراج اتباع بیگانه برای نخستین بار در ماده 274قانون منسوخ مجازات عمومی مصوب 1304 مورد حکم قرار گرفت. در حال حاضر، قانون راجعبه ورود و اقامت اتباع خارجه مصوب 1310 و قانون مجازات اسلامی مصوب 1392 ، احکامی رادر زمینه اخراج اتباع خارجی پی شبینی کرد هاند. اخراج اتباع می تواند قبل از ارتکاب جرم و بهدلایلی مانند وجود حالت خطرناک در فرد و بعد از ارتکاب جرم و ب هعنوان مجازات تکمیلی باشد.پی شبینی اخراج بیگانه ب هعنوان مجازات تکمیلی که علاوه بر تحمل مجازات اصلی جرم ارتکابیاست، برای اولین بار در قانون مجازات اسلامی 1392 پی شبینی گردید.

چکیده انگلیسی مقاله Context and Objectives: Expansion of international relations as well as the developmentof various political and social issues in the world have increased the relationsof the world›s people and the entry of foreign nationals to various countries,including Iran, which can in some cases create conflicts with the interests of thehost country and create different legal problems. Accordingly, the purpose of thisstudy is to investigate various legal issues related to the expulsion of foreign nationalsfrom Iran and the important and fundamental challenges associated with it.Research method: The present research is based on analytical method based onlibrary resources.Findings and Conclusion: In the international law, no state is obliged to admitforeign nationals or to agree to their continued presence in their territory and canexpel him if he sees the presence of a foreign person in conflict with his interests.The discretion of governments in this regard is absolute and due to the principle ofthe sovereignty of states, but it is possible, through some principles of internationallaw, such as the prohibition of illicit use of the right to dismiss and respect for theprinciple of good faith and the principle of non-refoulement, to restrict the powerof states to expel foreigners. The nature of the expulsion is that when the state orjudiciary decides to do so, the will of the individual does not affect it. The dismissalof foreign nationals for the first time was ruled out in Article 274 of the outlawedPublic Penal Code of 1304. Currently, the law on the entry and residence of foreignnationals approved in 1310 and the Islamic Penal Code, approved in 1392, haveenacted rulings on the expulsion of foreign nationals. Expulsion of foreign nationalscan be done prior to committing a crime for some reason, such as the existenceof a dangerous state in the individual and after the commission of a crime and asa punishment. The anticipated expulsion of foreigners as supplementary punishment,was for the first time enacted in the 1392 Islamic Penal Code.
