عنوان فارسی کمیسیون‌های دسترسی به اطلاعات در پرتو حقوق فرانسه
چکیده فارسی مقاله با درنظرگرفتن اهمیت حق دسترسی به اطلاعات، جایگاه این حق در میزان مشارکت شهروندان در جوامع مردم‌سالار، قابل‌چشم‌پوشی نیست. همچنین این حق نقش مهمی را در حمایت از حقوق و منافع افراد و جلوگیری از فساد اداری و افزایش شفافیت اداری برعهده دارد. با وجود تفاوت‌های موجود در اعمال حق دسترسی به اطلاعات در نظام‌های حقوقی ایران و فرانسه، باید توجه داشت که در دوره کنونی، کلیت این امر در نظام حقوقی هر دو کشور پذیرفته شده‌است. در هریک از این دو کشور، نهادی به‌منظور نظارت بر رعایت این حق ایجاد شده که در ایران کمیسیون انتشار و دسترسی آزاد به اطلاعات و در فرانسه، کمیسیون دسترسی به اسناد اداری نام گرفته‌است. در این‌مقاله تلاش شده تا ضمن بررسی چگونگی شکل‌گیری کمیسیون‌های دسترسی به اطلاعات در حقوق اداری ایران و فرانسه، ساختار و وظایف این کمیسیون‌ها نیز مورد بررسی قرار گرفته و به ایرادات موجود در این خصوص اشاره شود.

چکیده انگلیسی مقاله The right of access to information is one of the most important principles, and plays the undeniable role regarding the participation of citizens in democratic societies. This right also plays an important role in protecting the rights and interests of individuals, preventing the administrative corruption and also increasing the administrative transparency. It should be noted that today, this issue has been accepted despite differences in Iranian and French legal systems. In each of these two countries, an institution has been created to control the observance of this right, which in Iran is the Commission for publishing and free access to information, and in France is the Commission for access to administrative documents. In this paper, it is attempted to examine the structure and tasks of theses commissions and to highlight their bugs, while expressing the way of constitution the commissions for access to administrative documents in Iranian and French administrative laws.
