عنوان فارسی بررسی رابطه قواعد ساختاری نظام جامع رفاه و تأمین اجتماعی و قواعد ماهوی این نظام
چکیده فارسی مقاله قانون ساختار نظام جامع رفاه و تأمین اجتماعی مصوب 1383، ساختاری مرکب از اصول، سیاست‌ها، اجزاء و ارکان را فراهم می‌کند که قوانین ماهوی در قالب آن، تنظیم و اجرا می‌شود. از این منظر، بررسی رابطه مقررات قانون نظام جامع با قوانین ماهوی سابق، از اهمیت ویژه و خاصی برخوردار است. در پژوهش حاضر، این بخش از قانون نظام جامع رفاه و تأمین اجتماعی درباره اصول و سیاست‌های این نظام مورد بررسی قرار گرفته و ثابت شده است که هر چند احکام مذکور - در عمده موارد- با قوانین ماهوی سابق آنگونه در تعارض نیست که بتواند ناسخ یا مخصص آنها دانسته شود، لکن ماهیت آن به گونه‌ای است که می‌تواند مفسر قواعد ماهوی سابق و لاحق قرار گیرد. در پژوهش حاضر، نقش اصول و سیاست‌های حاکم بر نظام جامع رفاه و تأمین اجتماعی در تفسیر احکام و مقررات ماهوی نظام یاد شده، مورد بررسی قرار گرفته است.

چکیده انگلیسی مقاله Comprehensive Welfare and Social Security System Structure Act, ratified in 2004, brings about a structure, composed of principles, policies, components as well as fundaments within which the substantive laws are regulated and enforced. From such a perspective, it holds a pivotal position to study the relationship between the regulations of Comprehensive Welfare and Social Security System Act and the former substantive laws. The present article studies this aspect of Comprehensive Welfare and Social Security System Act regarding the principles and policies of the system. Meanwhile, it is proven that although the verdicts concerned do not contradict with the former substantive laws in a way to consider them as its abrogation or appropriation, its essence is of such a type that could be employed as the exegete of the former or subsequent substantive rules. This research tries to study the role of the principles and policies dominant on the Comprehensive Welfare and Social Security System in the exegesis of the verdicts and substantive regulations.
