عنوان فارسی اهمیت کالبدشکافی در دادرسی‌های قضایی
چکیده فارسی مقاله مقدمه: حق حیات از حقوق مسلم شناخته شده برای بشر است و در صورتی که بدون مجوز قانونی سلب شود، بایستی در اسرع وقت و با امکانات کافی نسبت به کشف جنایت و رساندن عامل یا عاملین قتل به سزای جنایت اقدام گردد. یکی از راه‌های کشف جرم، اقدامات دقیق پزشکان قانونی است. این مقاله ضمن بررسی مفهوم کالبدشکافی، اهداف و شیوه های آن به اهمیت و تأثیر آن در اجرای عدالت و مسؤولیت پزشکان قانونی در این امر خواهد پرداخت. بحث: کالبدگشایی در دادرسی کیفری از اهمیت بالایی برخوردار است و تشخیص منطبق با واقعیت پزشکان، چراغ راه قاضی برای کشف حقیقت خواهد بود. دستوری یا تکلیفی بودن این امر برای پزشکان معاینه کننده از موضوعات مورد بحث در این مقاله است که رویکرد دو پهلوی قانونی آن به تصویر کشیده شده است. مقنن گاهی نظر به استقلال قضات داشته و در مواردی تأکید به اهمیت تخصص و علم می نماید که این دو سویه عمل کردن بدون توجه به تعیین تکلیف در خصوص اولویت آن‌ها در عمل، مشکلاتی را برای مقامات قضایی و پزشکان قانونی ایجاد نموده است. فرآیند تاریخی کالبدگشایی در قوانین جزایی و آیین دادرسی کیفری ایران اسلامی بررسی و به نوع نظارت قضات و نقش پزشکان قانونی در قالب‌های مختلفِ خبره، کارشناس ویا متخصص پرداخته شده است. با توجه به اینکه قوانین ایران اسلامی منشأ مذهبی مبتنی بر مقررات دین مبین اسلام بر اساس قانون اساسی دارد، نظر فقهای اسلامی در خصوص کالبدگشایی مطرح و نشان داده شده که علی‌رغم ممنوعیت اولیه فقهی تشریح، در مواردی و با رعایت شرایطی این امر مجاز شناخته شده است. نتیجه گیری: کالبدگشایی، در مواردی که برای کشف حقیقت ضرورت دارد، از اهمیت بسزایی برخوردار بوده و برای اجرای عدالت لازم است. این امر در اصل تشریح نیاز به مجوز قضایی داشته لیکن پزشک در انتخاب نوع عملیات تشریحی و اقدامات تشخیصی مختار خواهد بود .

One of the ways of crime discovery is the exact functions of legal medicines. This essay, in addition to significance of autopsy, will discuss the ideas, methods and its effects in. Justice performance and responsibility of legal medicines. Discussion: Autopsy has a great importance in criminal procedure and recognition of reality with legal medicines that helps judge to find the truth of subject. this process is the subjects of argument for medicines in this essay and shows ambiguous approach of the law sometimes legislative authority emphasize on independence of the judge and in some instances emphasize on importance of proficiency and knowledge, that ambiguity act without attendance to fulfill of duty that related to those preferences also create any problems in judicial authorities and legal medicines. The historic process of autopsy must be surveyed in criminal law and criminal procedure of Islamic of Iran and also it is appropriates to kind of judges supervision and role of the legal medicines in different frames, skillful, expert, or proficient. Whereas rules of Islamic of Iran has religious era that rooted in percept of Islam religion based on constitution. The ideas of Islamic Jurisprudents has shown and plan about autopsy which nevertheless first interdict of .jurisprudents about anatomy in some cases his function is known lawful by regard to conditions of this terms . Conclusion: In some cases find out the truth autopsy has been a great importance. It is essential for the performance of justice. This matter needs judicial justification but physician will be free to choose the kind of anatomy's function and diagnostic acts.
