عنوان فارسی واکاوی اصول تعامل اخلاقی پلیس با جامعه در آثار حِسبه‌نویسان
چکیده فارسی مقاله ارتقای سطح کمّی و کیفی تعامل پلیس و جامعه که به افزایش سرمایۀ اجتماعی این سازمان منجر می‌شود، از دغدغه‌های مهم در مدیریّت پلیس جامعه‌محور است. حاکم شدن اخلاق بر رفتار پلیس می‌تواند نقش مهمّی در این زمینه داشته باشد. از سوی دیگر، در آثار دانشمندان اسلامی، عمدۀ مباحث مربوط به نحوۀ تعامل مجری قانون با مردم، به منابعی مربوط است که به امر حسبه پرداخته‌اند و در خلال آن‌ها به فرد محتسب، توصیه‌هایی اخلاقی شده است؛ و لذا این آثار می‌توانند منابع مناسبی برای واکاوی اصول تعامل اخلاقی پلیس با جامعه، در جوامع کنونی باشند. در این نوشتار با رجوع به آثار حسبه‌نویسان، توصیه‌های اخلاقی آن‌ها به فرد محتسب به عنوان ضابط قانون، جمع‌آوری شده و با در نظر گرفتن مهم‌ترین وظایف سازمان پلیس در جوامع کنونی، نحوۀ کاربست آن‌ها توسّط این سازمان، تبیین شده است. در نتیجۀ این پژوهش، مشخّص می‌شود که چهار اصل «صلابت و اقتدار»، «بی‌نیازی و غنا»، «تعهّد و التزام عملی به قانون» و «ترحّم و مهرورزی»، اصولی هستند که می‌توان آن‌ها را در توصیه‌های حسبه‌نویسان مشاهده کرد. در نگاه اوّل، برخی از این اصول، در تقابل با برخی دیگر به نظر می‌آیند، امّا انجام یک تبیین مفهومی درست از معنای این اصول اخلاقی در تعامل پلیس و جامعه و نیز افزایش بصیرت پلیس در شناخت مورد و تشخیص اصل اخلاقی حاکم در هنگام تزاحم این اصول، از جمله بایسته‌هایی هستند که می‌توانند مسیر را برای اجرایی شدن آن‌ها هموار کنند.

عنوان انگلیسی An Inquiry into the Principles of Moral Interaction of Cop with Society in the Works of lawmakers of inspectors (al-Mohtaseb)
چکیده انگلیسی مقاله The quantative and qualitative development of the interaction of the police officers and society, that increase the values of social asset of this organization, is one of the important concerns in the management of a police whose concern is society. From other hand, in the works of Islamic scientists, most of the discussions related to the line of interaction of the executor of the law with people associated with the sources dealt with inspection (al-Hesbah), through them some advices to the inspectors (al-Muhtasab) has been advanced. So these works could be a proper source for inquiring into the principles of moral interaction of the police with society in our societies. Referring to the works of the lawmakers of inspectors (al-Mohtaseb), this paper has collected their moral advices to the inspectors (al-Muhtasab), and by considering the most important duties of organization of police in our society, the function of them in this organization has been explained. The result of this investigation shows that four principles of power, needlessness, practical commitment to the laws, and kindness are the principles can be seen in the works of the lawmakers of inspectors (al-Mohtaseb). It seems prima facie that some of these principles are contradicting, but a proper conceptual explanation of these moral principles in the interaction of the police and society, as well as the development of the insight of the police in discerning instances and moral principles of the ruler on the practical contradiction, are from the requisites can facilitate the path of implantation of them.
