عنوان فارسی بررسی حقوق رقابت در قوانین و مقررات جهان و ایران با تمرکز بر بازار برق
چکیده فارسی مقاله با باز شدن پای بخش خصوصی به عرصه‏های مختلف تولید و تجارت کالاها، اهمیت وضع قوانین بازدارنده و اعمال مجازاتهای لازم برای مبادرت‎کنندگان به رویه‏های ضد رقابتی مضاعف می‏گردد. به همین سبب، نهادهای قانونگذار همواره جهت صیانت از حقوق مصرف‏کنندگان، رقبا و به طور کلی تمامی آحاد جامعه، اهتمام ویژه‏ای به وضع قوانین لازم در این زمینه و تشکیل نهادهای ناظر بر مسائل رقابتی در بازارها ‏دارند. بر این اساس مطالعه و شناخت مباحث حقوقی و اقتصادی مرتبط با مسائل رقابتی بازارها به ویژه در زمینه خدمات و کالاهایی که دارای اهمیت خاصی در شئوون مختلف زندگی مردم بوده و پیشتر نیز در قالب خدمات عمومی از طریق صنایع دارای انحصار طبیعی ارائه می‏شده اند، از اهمیت مضاعفی برخوردار می‏گردد. بازارهای انرژی به طور عام و بازار کالای برق به طور خاص، از این دست بازارها می‏باشند. در ایران، حقوق رقابت از مباحث نسبتاً جدیدی است که همزمان با اجرای اصل 44 قانون اساسی مورد توجه قرار گرفته است. با توجه به نیاز به شناخت دقیق از قوانین و مقررات در زمینه حقوق رقابت در کشورهای مختلف جهت الگوگیری و پیاده‏سازی در حوزه‏های گوناگون‎، این مقاله با اتخاذ یک رویکرد حقوقی و اقتصادی، با مطالعه مبانی حقوق رقابت در دنیا و ایران به ویژه در حوزه بازار برق ضمن اشاره به ویژگی‎های نهادهای کارآمد صیانت کننده از حقوق رقابت‎، برخی مشکلات بازار برق کشور را از دیدگاه حقوق رقابت بررسی می‏کند. مقایسه بازار برق کشور با بازارهای مطرح دنیا حاکی از وضعیت نسبتاً مطلوب شاخصهای ساختاری و وجود برخی مشکلات مقرراتی در بازار برق کشور است که نیاز توجه بیشتر به حقوق رقابت را نمایان می‎سازد. تاسیس نهاد تنظیم مقررات بخشی در حوزه برق علاوه بر رفع نواقص هیات تنظیم بازار برق می‌تواند نوید دهنده ایجاد یک برنامه جامع و کلان جهت انجام اصلاحات در صنعت برق کشور باشد.

عنوان انگلیسی Rules and Regulations on Competition Rights in Electricity Markets: A Comparative Study
چکیده انگلیسی مقاله It is essential to enact restrictive laws and impose penalties for private sector participants when they play an important role in different sectors of production and trading of commodities. These laws and penalties reduce antitrust activities and protect participants against illegal activities. Therefore, the study and recognition of legal and economic issues related to the competition in different markets specially in some commodity markets which play crucial role in peoples' lives is significantly important. Energy markets, particularly power markets are really important in humans' lives and everyone must has access to enough sustainable energy to maintain a high standard of living.  In Iran, competition rights is a new topic that has been considered based on the Article 44 Constitution of the Islamic Republic of Iran. The study of competition rights experiences around the world and using them for designing and implementing efficient laws in Iran is very important. In this article, by adopting a legal and economical approach, we study and investigate principle issues of competition rights in Iran and other countries, particularly in power markets. Then, the main features of efficient organizations which are responsible for monitoring competition rights are mentioned. Finally, the competition rights challenges in Iran power market are investigated. This research also investigates some challenges in Iran power market including structural and legislation problems that should be solved with taking some steps in order to provide competitive environment for market participants. The results of this research demonstrate some structural and legislation problems of Iranian power market which highlights the importance of paying more attention to competiton rights. Establishment of the sectoral regulator in power industry not only resolves some drawbacks of current Iranian power market regulator but also leads to a comprehensive plan for Iranian power market reforms.
