چکیده فارسی مقاله اندیشه مقابله با جرم هم متضمن توجیه چرایی و ضرورت اصل این کار بوده و هم توجیه مجازات و کارکردهایش در توجیه مجازات، نظریّه ی «بازدارندگی مجازات» یکی از کهن ترین آنهاست، نظریّه ای که ازآغاز تاکنون ارعاب و عبرت انگیزی را به عنوان غایت اعمال مجازات معرفی نموده و با تمرکز بر این بعد از مجازات و ایجاد هراس و واهمه در اذهان عمومی، در پی مقابله با انگیزه ها و وسوسه های مجرمانه و در نهایت تقلیل نرخ واقعی جرایم و برقراری امنیّت اجتماع بوده است. در این مقاله ابتدا به اختصار اهداف مجازات و سپس به شرح «نظریّه ی بازدارندگی مجازات» پرداخته شده و آنگاه تاریخچه ی پیدایش این تئوری و انتقادات وارده برآن مورد بررسی قرار گرفت. در پایان، از نتایج تئوری مزبور و همچنین ابزارهای مکمّل از حیث عملی و نه در چارچوب نظری و فلسفی سخن به بیان آمد.

چکیده انگلیسی مقاله Man has always preoccupied with the notion of wiping out the tsunami of crime –because of disturbing the public order and causing much problems on interpersonal relationships –and hence, the realization of this lifelong dream in the course of history has resulted in proposing various plans & systems. These theories –based on their own tools- have aimed to effectively deal with the problem of Crime and there stands the “the deterrent punishment theory” as one of the oldest ones, which has introduced deterrence and making example as the ultimate goal of punishment from the beginning till now.However, the theory of deterrent punishment has focused on these aspects to control and restrain the real frequency of crimes and at last it is intended to establish peace and security throughout the society. Thus, in the first step, we discuss the goals and objectives of punishment in short and then, we will explain the theory of deterrent punishment in detail and its history of origin and the critiques in literature, and finally a summary of its results and outcomes in addition to complementary tools will be presented.
