عنوان فارسی دانشگاه آزاد اسلامی: مؤسسه عمومی یا خصوصی؟
چکیده فارسی مقاله از نهادهایی که در خصوص ماهیت آن بحث وجود دارد، دانشگاه آزاد اسلامی است. در ماده 5 اساسنامه جدید این دانشگاه، ابتدا مؤسسه عمومی غیردولتی و در اصلاح بعدی، مؤسسه غیرخصوصی غیردولتی خوانده شد. عنوان «مؤسسه غیرخصوصی غیردولتی» در میان مؤسسات موجود در قوانین، شناسایی نشده است و به نظر می­رسد منظور از غیرخصوصی در کنار غیردولتی، عمومی است. اما آیا این دانشگاه یک مؤسسه عمومی غیردولتی است؟ برخی ویژگی­های شخصیت حقوق عمومی مانند ارائه خدمت عمومی و استفاده از برخی امتیازات قدرت عمومی در آن وجود دارد، اما در سایر معیارها ویژگی اشخاص حقوقی حقوق خصوصی را دارد. با اینکه در اساسنامه، یک مؤسسه عمومی غیردولتی(یا غیر خصوصی غیردولتی) خوانده شده است اما طبق قانون مدیریت خدمات کشوری، شناسایی، ایجاد و انحلال مؤسسات عمومی غیردولتی در انحصار مجلس شورای اسلامی است. به همین دلیل اگر بخواهیم دانشگاه را مؤسسه عمومی غیردولتی بدانیم، نیازمند شناسایی از سوی قانون­گذار است.

چکیده انگلیسی مقاله One of institutions that there is doubt about its nature is Islamic Azad University. In Article 5 of the new constitution of Islamic Azad University determined at first as a non-governmental public institution, and in later amended, a non-private non-governmental institution. The term "non-private non-governmental organization" is not recognized within the institution in law and it appears that Council's goal from using non-governmental near non-private is public. But is the Islamic Azad University a non-governmental public institution? There are some of public law personality's features such as doing public service and using some of the power rating in the university but in the other criteria, it has the privacy law persons features. Despite in the new Constitution, university is called as a non-governmental public institution but according to civil service management act, identification or creation and abolishing a non- governmental public institutions do only by monopoly of the Islamic Consultative Assembly. Therefore if we want to know the university as a non-governmental public institution we need to clarify the identification as a non-governmental public institution by the legislator.
