عنوان فارسی اصل برابری و نظارت قانونی بر اجرای انتخابات نهادهای سیاسی
چکیده فارسی مقاله کمیت و کیفیت نظارت بر انتخابات نهادهای سیاسی در برقراری اصل برابری انتخاباتی نقش مهمی را ایفا می‌نمایند. نهاد نظارت بر انتخابات با مراقبت بر عملکرد مجریان انتخابات و نظارت بر اجرای دقیق قوانین انتخاباتی در تضمین اصل برابری در قوانین انتخاباتی موثر است و به عنوان یکی از نهادهای مجری قوانین انتخاباتی در تامین اصل برابری در مقابل قوانین انتخاباتی نقش دارد. برای تضمین اصل برابری در قوانین انتخاباتی، تعیین سازکارهای مناسب برای مراقبت بر اجرای قوانین انتخاباتی و جرم انگاری اعمال خلاف قوانین انتخاباتی ضروری است. تامین اصل برابری در مقابل قوانین انتخاباتی نیازمند بی طرفی ناظران انتخاباتی است. به این منظور معیار نظارت بر اجرای انتخابات باید قاعده مند باشد و قواعد حقوقی مزبور باید به صورت عینی تعیین شوند

عنوان انگلیسی Principle of Equality and Legal Control on Holding the Elections in the Political Institutions
چکیده انگلیسی مقاله The quantity and the quality of the control on the elections of political institutions can play an important role on establishing the principle of electoral equality. The organ responsible for controlling elections can ensure the principle of equality in electoral laws by supervising on the functions of electoral officers and by supervising on the precise enforcement of electoral laws. Accordingly, as one of the institutions enforcing electoral laws, it can secure the principle of equality before the electoral laws. Therefore, it is necessary to determine the appropriate mechanisms for supervising the enforcement of the electoral laws and to determine the punishment for acts which are contrary to electoral laws in order to ensure the realisation of principle of equality in electoral laws. Realisation of the principle of equality before the electoral laws requires neutrality of electoral supervisors. Therefore, criterion of the control over elections must be regulated and the aforesaid legal regulations must clearly be determined.
