عنوان فارسی پژوهشی فقهی و حقوقی در مبانی تعمیم حکم سب النبی بر غیر نبی(ص)
چکیده فارسی مقاله شارع مقدس برای صیانت از جایگاه نبی اکرم(ص)، به‌عنوان معرف دین اسلام، جرم سب النبی را با آثار و احکام خاصی تشریع کرده است. هرچند عنوان مجازات سب النبی(ص) و موضوع آن «نبی» است، احکام آن به حضرت زهرا(س) و ائمۀ معصومین(ع) نیز تسری‌دادنی خواهد بود. اگرچه در مادۀ 262 و 263 قانون مجازات اسلامی، به‌صورت مختصر به جرم سب النبی اشاره شده است، با توجه به شخصیت والای پیامبر(ص) و امامان معصوم(ع) و وظیفۀ حفظ آن، بر عهدۀ قانون و از طرفی، خلأهای موجود در قانون در ارتباط با جرم سب النبی، در پژوهش حاضر سعی شده است که جنبه‌های مختلف جرم سب النبی تبیین شود. در این پژوهش با روش توصیفی ـ تحلیلی در صدد بررسی مبانی تعمیم حکم به غیرنبی(ص) بوده‌ایم و بر این باوریم که دوازده امام(ع) و حضرت فاطمه زهرا(س) همگی مانند یک نور پاک هستند و سب آ‌نها، در حکم سب النبی است. در نهایت دربارۀ مصادیقی که تعمیم حکم سب النبی بر آنها اختلافی است، پژوهش شده است.

عنوان انگلیسی Juridical and Jurisprudential Research in the Generalization Principles of the Ruling of Blasphemy against the Prophet (PBUH) (Sabb Al-Nabi) to Non - Nabi
چکیده انگلیسی مقاله The Divine Legislator, in order to protect the Nabi Akram (PBUH) as the representative of the religion of Islam, has legislated the crime of the blasphemy against the Prophet (PBUH) with a special rulings and effects. Although the crime titled the “blasphemy against the Prophet (PBUH)” and its subject is also “Nabi”, its rules can also be generalized to Hadrat Zahra (S) and the Infallible Imams (AS). Although the Articles 262 and 263 briefly refer to the crime of the blasphemy against the Prophet (PBUH), considering the lofty characters of the Prophet (PBUH) and the Infallible Imams (AS) and the legal responsibility to maintain them on the one hand and the existing gaps in the law pertaining to the crime of the blasphemy against the Prophet (PBUH) on the other hand, the present research tries to explain the various aspects of the crime of blasphemy against the Prophet (PBUH). The study, using a descriptive-analytical method, seeks to review the principles of generalization of the ruling to non-prophet. It believes that the twelve Imams (AS) and Hadrat Zahra (S) all are like a single pure light and the blasphemy against them equals the blasphemy against the prophet (PBUH). Finally, a number of instances to which the generalization of the ruling of the blasphemy against the Prophet (PBUH) are controversial have been studied.
