عنوان فارسی مطالعۀ تطبیقی ماهیت حکم شرعی در دانش اصول
چکیده فارسی مقاله تأمل در حقیقت و چیستی مفاهیم اساسی حوزۀ استنباط و فقه و قانون، به‌ویژه مفهوم حکم شرعی و قانونی از جمله دغدغه‌های دیرین اهل نظر دراین زمینه بوده است. اما با وجود اهمیت مبحث، کوشش مؤثری در این زمینه صورت نگرفته است. برای پاسخ به این مطالبه نظریه‌های سه‌گانۀ مطرح پیرامون حقیقت حکم، یعنی نظریه‌های «خطاب»، «جعل» و «اعتباری بودن حکم شرعی» را بررسی می‌کنیم و ضمن انتقاد از نظریۀ جعل به‌واسطۀ عدم لحاظ مراتب جعل‌ناشدنی احکام در تعریف و تحلیل حکم و نظریۀ خطاب به‌سبب عدم افادۀ معنای محصل از حقیقت حکم، عنصر اعتبار و تشریع را بنیان اساسی احکام و قوانین دانسته‌ایم که در عین ناظر بودن به مصالح و مفاسد واقعی و نفس‌الامری، با توجه به مراتب تکوینی

عنوان انگلیسی Comparative study of quiddity of legal verdict
چکیده انگلیسی مقاله Dellberation in reality and quiddity of basic concepts of areas of inference, jurisprudence and law, especially concept of legal verdict has been one of the oldest apprehensions of clear-sighted scholars. But in spite of importance of this subject, effective effort regarding it has not been done. In order to answer this demand in this paper, we have studied three theories propounded on reality of verdict, i.e., theory "address", theory "convention" and theory "legislation of legal verdict", and have regarded principle legislation as basis of laws and verdicts, and have criticized theory "convention" because of unconsideration to unconventional levels of verdicts in description and analysis of verdict, and theory "address" because of not conveying meaning obtained from reality of verdict. The verdicts have legislated considering observation on real good and bad purposes and on creative levels of will of legislator.
