عنوان فارسی بررسی قاعده عدل و انصاف و آثار آن
چکیده فارسی مقاله قاعده عدل و انصاف آثار فراوانی در فقه دارد. این مقاله درپی اثبات این قاعده با استدلالات فقهی، عدل و انصاف را از نظر لغت و اصطلاح معنا می‌کند و برای اثبات آن به دو دسته دلیل تحت عنوان دلایل عمومی و خصوصی می پردازد تا کلیت و عمومیت قاعده را اثبات کند. در بخش دیگر، مصادیقی را از ابواب فقه برمی‌شمرد و رابطه بین این قاعده را با قاعده قرعه مورد توجه قرار می‌دهد و به اثبات می‌رساند که قاعده عدل و انصاف بر قاعده قرعه مقدم است. در بخش پایانی مقاله، ضمن بیان نتیجه این قاعده یادآوری می کند که فقیه باید در استنباط احکام به این قاعده توجه نماید و در صدور فتوا از آن بهره گیرد.

چکیده انگلیسی مقاله T his word is paid attention to throughy general and specific reasons, and so the This article is to investigate the Justice Principle, which is a rule of figh (canonical law) with many effects, and to prove it via legal reasons. At first, the article considers the importance of justice according to the nobles, statements; then, in the main body of the article, the meaning of generality of this principle is proved. In another part of the article, legal examples of this principle are mentioned, and the relationship between this principle and the lost-drawing principle is cited; it is also proved that the former is prior to the latter. And finally, the consequence of this principle is explained; it is also concluded that an Islamic jurist has to regard this principle in his decree (fitwa), and some examples are also mentioned in this regard.
