عنوان فارسی مقایسه‌ سطوح دسترسی و محرمانگی مدارک پزشکی در کشورهای منتخب و ایران
چکیده فارسی مقاله مقدمه: بدون شک پرونده پزشکی یکی از مهم‌ترین مدارک و حاوی حساس‌ترین اطلاعات پزشکی و بهداشتی درمانی افراد می باشد که حفظ محرمانگی اطلاعات مندرج و اسناد و مدارک موجود در آن از اولویت بالایی برخوردار است. در صورتی که معیاری برای ارزیابی و بهبود و حفظ محرمانگی تعریف نشود، این اطلاعات به میزان وسیعی منتشر و مشکلات عدیده حقوقی، اجتماعی و اقتصادی به دنبال خواهد داشت. هدف از مطالعه این پژوهش با عنایت به اهمیت موضوع محرمانگی مدارک پزشکی و تأثیر آن در بهبود عملکرد بیمارستان، بررسی سطوح دسترسی و محرمانگی مدارک پزشکی در کشورهای منتخب و ایران و تعیین شکاف موجود می باشد. روش بررسی: این پژوهش از نوع توصیفی ـ تطبیقی بوده که به روش مقطعی انجام شده است. جامعه پژوهش شامل کشورهای مورد مطالعه کانادا، استرالیا، آمریکا، انگلستان و ایران می باشد. این کشورها به جز ایران به دلیل پیشرفت قابل توجه در زمینه محرمانگی مدارک پزشکی انتخاب شده‌اند. داده‌های پژوهش با استفاده از اینترنت و برقراری ارتباط با افراد صاحب نظر و سازمانهای دست اندرکار از طریق پست الکترونیکی جمع‌آوری شده است و گردآوری اطلاعات مربوط به ایران از طریق مطالعات کتابخانه‌ای، بخشنامه‌های موجود بوده است. یافته‌ها: نتایج حاصل از این بررسی، نشان داد که در ایران سازماندهی منسجمی وجود ندارد که متولی مدیریت بحث محرمانگی مدارک پزشکی و تدوین استانداردهای آن باشد. وضعیت مدارک پزشکی، محرمانه سازی و سطوح دسترسی به مدارک پزشکی در ایران با استانداردهای جهانی فاصله زیادی دارد. عدم تطابق عملکرد بخش مدارک پزشکی بیمارستان‌های ایران با فعالیت‌های استاندارد تعریف شده در کشورهای پیشرفته و نامطلوب بودن روشهای انجام کار، باعث انحراف مسیر فعالیت‌های این بخش از اهداف اصلی خود شده است. نتیجه گیری: بدیهی است با توجه به کاربرد وسیع مدارک پزشکی برای مقاصد مختلف نظیر اخذ مشاوره پزشکی، طرح و استناد در مجامع قضایی و حقوقی، سازمان‌های بیمه‌گر و انجام تحقیقات بهداشتی، رعایت اصول محرمانگی امری ضروری است. ضمن اینکه، بهره‌گیری از محتویات پرونده برای مقاصد فوق‌الذکر نیز ضروری به نظر می‌رسد و می‌بایست به هنگام تداخل بین حقوق بیمار و حقوق عمومی، قضاوت صحیحی براساس قانون به عمل آید. نتایج حاصل از این پژوهش به شفاف‌سازی وضعیت قوانین و استانداردهای ویژه حفظ محرمانگی ایران، در مقایسه با کشورهای مورد مطالعه کمک کرده و برای تدوین و اصلاح قوانین بخش بهداشت ودرمان کشورمان جهت مدیریت موثر بر اطلاعات حساس پزشکی مفید خواهد بود.

عنوان انگلیسی Acomparative investigation of the access levels and confidentiality of medical documents in Iran and selected countries.
چکیده انگلیسی مقاله Introduction: Undoubtedly, the medical record is one of the most important documents containing the most sensitive information on the public health and treatment. As a matter of fact, protecting the confidentiality of the recorded information and the documents there in should be given top priority. Thus, given the importance of the confidentiality of medical document, and their impact on the better performance of hospitals, this study investigates the access levels and confidentiality of medical documents in Iran and selected countries and makes and effort to identify the existing gap.Methods: This study is a descriptive - comparative one which uses a cross - sectional style. The research sample includes Canada, Australia, USA, and England. It is because these countries have made considerable progress in the confidentiality of medical documents. The study data were gathered via internet and communication with professionals and relevantorganizations in the countries. In the case of Iran, the data were collected, using library studies.Results: It is concluded that there is no integrated organization for the management of medical documents and the development of its standards. 1) The status of medical documents, onfidentiality and access levels of medical documents in Iran are far from world standards. 2) The lack of consistency between the performance of medical documents in Iran hospitals and standard activities in developed countries has resulted in the gap between existing activities and stated purposes. 3) The countries under study have made great progress in confidentiality of medical record.Conclusion: It is evident that due to extended application of medical records for several ntention including medical consultations, authentication in legal cases, third parties and health researches, addressing privacy principles is essential. Meanwhile utilization of records content for above mentioned objective also is important and it must be taking correct action while interference patient privaet and public rights. With studied countries will be useful to develop and correct national health care rules for effective management of vital medical information.Undoubtedly, the medical record is one of the most important documents containing the most sensitive information on the public health and treatment.
