عنوان فارسی جایگاه مدیریت محله محور در حقوق اداری ایران
چکیده فارسی مقاله محله‌محوری بر پایه ایده ساماندهی و اداره امور شهر با کمک گرفتن از شهروندان ساکن در هر محله استوار است و به حل سریع‌تر مسائل و مشکلات شهری منجر می‌شود. مطابق این الگو، از گرد هم آمدن نمایندگان اهالی محله، یک نهاد محلی شکل می‌گیرد. نهاد مربوطه، در شهرهای مختلف، تحت عناوینی مثل «شورایاری» یا «شورای اجتماعی محله» شناخته می‌شود. مسئله پژوهش حاضر، یافتن جایگاه مدیریت محله‌محور و شورای محله در حقوق اداری ایران است. بر این اساس، به نظریه تمرکززدایی پرداخته شد و پرهیز از مدیریت شهریِ متمرکز و توزیع قدرت در سطح محلات شهرها، در ذیل آن نظریه، مورد بحث قرار گرفت. هم‌چنین، قانون اساسی، قوانین عادی، رویه قضایی و رویکرد قوه مجریه جمهوری اسلامی ایران بررسی شد و جایگاه محله‌محوری در آن‌ها تبیین گردید. به‌علاوه، از باب واکاویِ موانعِ پیش‌روی محله‌محوری، محدودیت‌های شوراهای شهر به‌عنوان مراکز قدرت‌دهنده به شوراهای محلات، ارزیابی شد. این مقاله از روش توصیفی- تحلیلی بهره برد و نتایج پژوهش نشان داد الگوی محله‌محوری و تشکیل شورای محله، از پشتوانه محکمی در اندیشه‌های حقوقی و قانون اساسی جمهوری اسلامی ایران برخوردار است اما جایگاهش در قوانین عادی و رویه قضایی کشور، قابل قبول نیست و در طول سال‌های گذشته، نتوانسته کارآمدی خود را اثبات کند. در پایان پیشنهاد شد دو اقدام صورت گیرد: اولاً، اختیارات شوراهای شهر افزایش یابد و مدیریت یکپارچه شهری شکل بگیرد؛ ثانیاً، موضوع شوراهای محلات، از سطح مصوبات شوراهای شهرهای مختلف فراتر رود و به صورت قانون، به تصویب مجلس شورای اسلامی برسد.

عنوان انگلیسی The position of neighborhood-based management in administrative law in Iran
چکیده انگلیسی مقاله Pivotal-neighborhood is based on "organizing and managing city affairs with the help of citizens living in neighborhood" and leads to faster resolution of urban issues and problems. According to this pattern, a local institution is formed from the gathering of representatives of the neighborhood. The institution is known in various cities as the "Shorayari" or the "Neighborhood Social Council". The aim of present study is to find the position of neighborhood management and neighborhood council in Iranian administrative law. Accordingly, the theory of decentralization was investigated and avoidance of centralized urban management and distribution of power at the neighborhoods were discussed under that theory. Also, the constitution, ordinary laws, judicial procedure and approach of the executive branch of the Islamic Republic of Iran were reviewed and the position of pivotal-neighborhood in them, was explained. In addition, in order to analyze the obstacles facing pivotal-neighborhood, the limitations of city councils as empowering centers to neighborhood councils were assessed. This article used a descriptive-analytical method and results showed that pivotal-neighborhood model and neighborhood councils have a strong support in legal ideas and constitutional of the Islamic Republic of Iran but its position in the ordinary laws and judicial procedure is not acceptable and over the years, it has not been able to prove its effectiveness. In the end, it was suggested that two measures be taken: First, the powers of city councils should be increased and integrated urban management should be formed. Secondly, the issue of neighborhood councils goes beyond the level of approvals of city councils and is approved by the Assembly as a law.
