عنوان فارسی تحلیل خدمات عمومی از منظر حقوق بشر؛ حق بر بهره‌مندی از خدمات عمومی
چکیده فارسی مقاله مقاله حاضر با جمع‌آوری اطلاعات به‌صورت کتابخانه‌ای و با به‌کارگیری روشی توصیفی و تحلیلی، در فضای دکترین حمایت از حقوق بشر، حاکمیت مسئول و نظریه تعهدات مثبت، به دنبال حمایت از مصادیق حقوق بشر در ادبیات خدمات عمومی است. چرا که بسیاری از مصادیق حقوق بشر بدون تدارک و مدیریت ارائه خدمات عمومی، قابلیت تحقّق ندارند. حق حیات، به عنوان اساسی‌ترین حق بشری، بدون ارائه خدمات عمومی، محتوایی جز «حق بر کشته نشدن» ندارد. این در حالی است که حق حیات، الزامات کیفی والاتری را در بر می‌گیرد؛ حقوق رفاهی مثل حق بر سلامت، حق بر خوراک، حق بر کار، حق بر آموزش و پرورش و... نیز بدون ارائه خدمات عمومی، قابل تحقّق نیستند. بر این اساس حمایت از حقوق بشر ایجاب می‌کند که ارائه و مدیریت خدمات عمومی به‌عنوان تعهّدی مثبت از سوی دولت‌ها تضمین گردد. با این رویکرد، الزام به ارائه خدمات عمومی، پشتوانه حقوق بشری خواهد داشت.

عنوان انگلیسی Analysis of public services from the perspective of human rights; Right to enjoyment of public services
چکیده انگلیسی مقاله Present article by using a desk research method to collect information and by using descriptive and analytical method, in the context of the doctrine of protection of human rights, the responsible sovereignty and the theory of positive obligations, seeks to support human rights cases in the public service literature. On the basis of this fact, many human rights cases are not feasible without the provision and management of public services. The right to life as the most fundamental human right, without the provision of public services, has no content other than "Right to not being killed". While the right to life includes higher qualitative requirements; Welfare rights such as the right to health, the right to food, the right to work, the right to education and etc. which could not be achievable without the provision of public services. Accordingly, the protection of human rights requires that the provision and management of public services be guaranteed as a positive commitment by governments. With this approach, the requirement to provide public services will have human rights support.
