عنوان فارسی ضرورت‌ها و موانع تجمیع صندوق‌های بازنشستگی در ایران
چکیده فارسی مقاله یکی از سازوکارهایی که در نظام حقوقی ایران برای نظارت بر صندوق­های بازنشستگی و ایجاد هماهنگی میان آنها مورد توجه قرار گرفته، تجمیع صندوق­های بازنشستگی بوده است. با وجود آنکه تجمیع صندوق­ها به معنای جمع شدن آنها با حفظ شخصیت حقوقی زیر نظر یک نهاد برتر، در قانون مدیریت خدمات کشوری، پیش‌بینی شده، اما تاکنون این موضوع به طور کامل، محقق نشده است. مقاله کنونی که با هدف امکان‌سنجی تجمیع صندوق‌های بازنشستگی ایران به رشته تحریر در آمده است؛ با استفاده از روش مطالعات کتابخانه­ای به بررسی مفهوم، ضرورت­ها، مراجع صلاحیتدار و اقدامات صورت گرفته در راستای تجمیع و موانع آن پرداخته است. بررسی­های مقاله نشان می­دهد به دلایلی چون ناهماهنگی میان صندوق­ها، فقدان نظارت موثر بر آنها و نیز نایده گرفته شدن برخی سیاست­های دولت توسط صندوق­ها، تجمیع آنها در وضعیت کنونی، ضرورت دارد. با این حال، با وجود آنکه بسترهای قانونی این اقدام در ایران تا حد زیادی فراهم است؛ اما در این راه موانعی چون تعارض تجمیع با استقلال صندوق‌ها، تعارض با سیاست­ کوچک‌سازی دولت و مخالفت مدیران عالی کشور نیز وجود دارد. بر این اساس، امکان تجمیع صندوق­های موجود در گروی رفع موانع موجود از طریق سازوکارتقنینی و نیز همراهی کردن اداره‌کنندگان صندوق­های بازنشستگی است.

عنوان انگلیسی Necessities and Barriers on the Aggregation of Pension Funds in Iran
چکیده انگلیسی مقاله One of the mechanisms that is foreseen in Iran's legal system to monitor pension funds and to create coordinate between them is the aggregation of pension funds. Although the aggregation of pension funds, namely getting them together by keeping their legal person under the control of a superior institution, has been foreseen in State Services Management Law (1386), this hasn't yet been achieved. This article that has been written for the purpose of feasibility of pension funds aggregation in Iran, using the method of library studies in two sections, the concept, necessities, qualifications and barriers to aggregation of funds. The article review, shows for reasons such as incoordination between the funds, the lack of effective oversight of them, as well as the ignored some policies by the government, it is necessary to aggregate them. However, although the legal framework for this action in Iran is largely provided but in this way there are obstacles such as the conflict of aggregation with the independence of the funds, the conflict with the policy of minimizing government and the opposition of the top executives of the country. Accordingly, the possibility of aggregation of existing funds depends on the removal of barriers through legislative mechanisms and the accompaniment of pension fund administrators.
