عنوان فارسی نظریه «ساختار حقوقی توسعه‌گرا و هماهنگ تدوین ضوابط طرح‌های توسعه شهری ایران»
چکیده فارسی مقاله اهداف و زمینه‌ها: پژوهش با این دغدغه آغاز شد که «قوانین شهرسازی به‌ویژه ضوابط طرح‌های توسعه شهری کارایی مناسبی ندارند». بامطالعه پژوهش‌ها مشخص شد طرح‌های شهری از بعد حقوقی و ضوابط دارای ناکارایی‌های هستند. ریشه برخی از این ناکارایی‌های در «ساختار حقوقی و قوانین» است. بنابراین با ریشه‌یابی ناکارایی‌های ساختار حقوقی و قوانین، دستیابی به نظریه‌ای برای ساختار حقوقی تدوین ضوابط و مقررات طرح‌های توسعه شهری، هدف پژوهش گردید.  روش‌شناسی‌: این پژوهش کیفی و به شیوه تئوری داده‌بنیاد انجام شد. انتخاب افراد مصاحبه‌شونده از میان نخبگان و با تحصیلات فوق‌لیسانس و دکتری به روش گلوله برفی بوده و اسناد مطالعاتی شامل مقاله‌های بین سال‌های 1380 تا 1401 است. تمام داده‌ها در چارچوب روش‌پژوهش  به‌کمک روش تحلیل محتوی در فرایند کدگذاری قرار گرفت و روایی پژوهش به دو روش ده پرسش کرسول (تائید مشارکت‌کنندگان) و مقایسه با ادبیات تخصصی بررسی و درستی آن گواهی شد. یافته‌ها: ناکارایی‌های ضوابط طرح‌های شهری دارای ریشه‌ها، زمینه‌سازها و شرایطی است که به مقوله «ساختار حقوقی فرایند تدوین ضوابط» با کد محوری «ساختار ناهماهنگ و چندپاره» برمی‌گردد و دارای عناصر، ارتباط و ترتیبی است که برسازنده ناکارایی‌هاست. در بیشتر مراحل تهیه طرح «متولی حقوقی تدوین ضابطه»، حضور ندارد و «ناهماهنگی و ناسازگاری در فرایند تدوین ضوابط»، «ناهماهنگی و ناسازگاری در مبانی نظری»، «ناهماهنگی در ساختار نظام تدوین» و «ناهماهنگی و ناسازگاری در ساختار و عناصر حکمروایی» از دیگر یافته‌های پژوهش است. نتیجه‌گیری: ساختار حقوقی تدوین ضوابط و مقررات طرح‌های توسعه شهری که می‌توان آن را ساختار حکمروایی برنامه‌ریزی شهری یا تدوین ضابطه آن نامید، دارای پدیده کانونی «هماهنگی و توسعه‌گرا» است که در تعامل با شرایط مداخله‌گر و زمینه‌ساز به نظریه «ساختار حقوقی هماهنگ و توسعه‌گرای تدوین ضوابط و مقررات» با راهبردهای «ساختار حقوقی هماهنگ با رویکرد حکمروایی شهری هماهنگ» و «فرایند هماهنگ و سازگار با کلان‌هدف توسعه» رهنمون دارد.

عنوان انگلیسی The theory of "developmental and coordinated legal structure for the formulation of criteria for Iran's urban development plans"
چکیده انگلیسی مقاله Objectives and contexts: The research started with the concern that "urban planning laws, especially the rules of urban development plans, are not effective". By studying the conducted researches, it was found that urban plans have inefficiencies from the legal and regulatory aspect. The root of some of these inefficiencies is in the "legal structure and laws". Therefore, the aim is to obtain a theory for the legal structure of compiling the rules and regulations of urban development plans. Methodology: The Reaserch method is GT. The selection of interviewees and study documents was done in a purposeful way by the snowball method, and the interviews were done by the content analysis method. The validity of the research was carried out by two methods of Creswell's Ten Questions and Comparison with specialized literature, and the correctness of the research process and result was certified. Findings: The inefficiencies of urban planning regulations have their roots, foundations, and conditions that return to the "legal structure of the process of developing regulations" with the core code of "uncoordinated and fragmented structure". In most of the stages of preparation of the project, the "legal guardian of the regulation" is not present and "inconsistency and inconsistency in the process of drafting rules", "inconsistency and inconsistency in theoretical foundations", "inconsistency in the structure of the drafting system" and "inconsistency and inconsistency in the structure and elements" Ruling" is one of the other findings of the research. Conclusion: The legal structure of urban planning which can be called the Governance structure of urban planning has the focal phenomenon of "coordination" and "developmentalism" which interacts with intervening conditions and lays the groundwork for the theory of "coordinated legal structure" and guided by the strategies of "harmonized legal structure with a coordinated urban governance approach.
