عنوان فارسی مسئولیت کیفری ناشی از انتقال ویروس کووید۱۹ در نظام حقوقی ایران
چکیده فارسی مقاله علی‌رغم شیوع ویروس کووید19 در کشور، به دلیل نوپدیداری، قدرت و سرعت بالای انتقال این ویروس، بسترهای کافی برای مواجهه ضابطه‌مند با آن در کشور، مانند بیشتر کشورهای جهان، فراهم نبوده است. تا پیش از شیوع ویروس مذکور، با وجود آنکه شیوع بیماری‌های واگیردار قبل‌تر نیز در کشور رخ داده، نگرش نظام حقوقی ایران به بیماری‌های واگیردار به‌مثابه یک واقعه گذرا بوده‌است. بر این اساس، مسئولیت منتقل‌کنندگان ویروس کووید 19 مطابق مقررات کیفری خاص قابل تطبیق تام نبوده، باید مسئولیت کیفری ناشی از انتقال ویروس مذکور را ذیل عمومات حقوق کیفری پی گرفت. هرچند وجود قانون خاص طرز جلوگیری از بیماری‌های آمیزشی و واگیردار می‌توانست نویدبخش وجود مقررات خاص در این حوزه باشد؛ اما قدمت قانون مذکور و عدم روزآمدی مانع از کاربست مؤثر آن می‌شود. بنابراین، در این مقاله تلاش می‌شود مسئولیت کیفری منتقل‌کنندگان ویروس کووید19 ذیل عناوین مجرمانه موجود در قوانین کیفری مورد تحلیل قرار گرفته، شرایط انطباق رفتار فرد مرتکب با هر یک از آنها تبیین گردد. در این راستا، پیشنهاد خواهد شد که به‌موجب دشواری‌های اثبات رابطه سببیت در احراز وقوع عناوین مجرمانه موجود، پیش‌بینی نظام قانونی خاص برای پیش‌گیری از شیوع هر چه بیشتر ویروس مذکور و سایر بیماری‌های واگیردار در دستور کار مقنن قرار گیرد.

عنوان انگلیسی Criminal liability for the transmission of Covid 19 virus in the Iranian legal system
چکیده انگلیسی مقاله Despite of the prevalence of Covid-19 in the country, due to itsemergence, power and high speed of transmission of the virus, there are notenough grounds for a standard response to it in the country, as well as themost countries of the world. Prior to the prevalence of the virus, although theprevalence of infectious diseases has occurred in the country before, theattitude of the Iranian legal system towards infectious diseases has been atransient event. Accordingly, the liability of the transmitters of the Covid-19is not fully enforceable under the specific criminal law and criminal liabilityfor the transmission of the virus must be pursued under the generalities ofcriminal law. However, the existence of a special law on the prevention ofsexually and infectious diseases could be promising for the existence ofspecial regulations in this area; However, the antiquity of the law and thelack of updates for it, prevent its effective application. Therefore, this articletries to analyze the criminal responsibility of the transmitters of Covid-19under the criminal headings in the criminal law and to explain the conditionsof compliance of the perpetrator's behavior with each of them. In this regard,it will be suggested that in view of the difficulties of proving the causation inoccurrence of existing criminal titles, the provision of a special legal systemto prevent the spread of the virus and other infectious diseases should beconsidered by the legislature.
