عنوان فارسی آموزش‌های الکترونیکی و چالش های نقض حقوق مالکیت ادبی و هنری در دوران کووید ۱۹
چکیده فارسی مقاله با ظهور کووید 19، استحاله‌ای جدی در عرصه‌های گوناگون زندگی، ازجمله سبک آموزش‌های عمومی و تخصصی ایجاد شده است. اگر در گذشته، کلاس‌های درس در محیطی فیزیکی با حضور رو در روی مدرسان و دانش آموزان/ دانشجویان برگزار می‌شد، در پی عصر کرونایی، تغییر مهمی در آموزش مدارس و دانشگاه‌ها به وقوع پیوست و آموزش مجازی به‌منظور استمرار فرایند آموزش و عدم توقف امر خطیر تعلیم و تربیت جایگزین شیوۀ پیشین شد. در کلاس‌های مجازی، محتواهای آموزشی شامل فیلم، موسیقی، مقالات و اسلایدهای آموزشی از سوی مدرس یا محصل برای تدریس یا تمرین‌های کلاسی در سامانه آموزشی ارائه می‌شوند. افزون بر اینکه، کلیت کلاس آموزشی نیز ضبط و متعاقباً در دسترس قرار خواهند گرفت. هریک از این موضوعات می‌توانند یک اثر مشمول حمایت نظام حقوق مالکیت ادبی و هنری( حق مؤلف / کپی‌رایت) باشند. بنابراین، پدیدآورندگان آنان اختیاردارند در خصوص نشر غیرمجاز و سایر بهره‌برداری‌های غیرمجاز، مدعی نقض حقوق مالکیت فکری و نیز سرقت علمی باشند. مسئلۀ پژوهش حاضر آن است که ابعاد و مخاطرات ناشی از حقوق مالکیت فکری آموزش‌های مجازی چیست و چگونه می‌توان این نگرانی‌ها را مدیریت کرد؟این مقاله با روش تحلیلی – توصیفی سرانجام نتیجه می‌گیرد که پدیدآورندگان آثار علمی، ادبی و هنری در فرایند آموزش‌های مجازی می‌توانند با توسل به فناوری‌های ناشی از مدیریت دیجیتال حقوق و بلاک‌چین، استفاده‌های ثانوی را مدیریت کنند. باوجوداین، استثنائات وارد بر حقوق مالکیت فکری قادرند حقوق و امتیازاتی را به سود منافع عمومی مقرر کنند. در این میان، تصویب دستورالعمل 2019 اتحادیه اروپا دربارۀ کپی‌رایت، معاهدۀ مراکش و رویۀ...

عنوان انگلیسی E-learning and the Challenges of Copyright Infringement in the Covid 19 era
چکیده انگلیسی مقاله With the advent of Covid-19, serious transformations have taken place invarious areas of life, including the style of general and specialized education.If in the past, classrooms were held in a physical environment with face-tofacepresence of teachers and students, following the Corona era, there was asignificant change in school and university education and virtual educationin order to continue the education process and not stop the serious matter ofeducation, E-Learning replaced the previous method. In virtual classrooms,instructional content, including videos, music, articles, and instructionalslides, is provided by the professors or students for teaching or classroomexercises in the instructional system. In addition; the entire training classwill also be recorded and subsequently made available. Each of these topicscan be a work protected by the system of literary and artistic property rights(copyright). Therefore, their creators have the right to claim infringement ofintellectual property rights and plagiarism in connection with unauthorizedpublishing and other unauthorized exploitation. The problem of the presentstudy is what the dimensions and risks of intellectual property rights in elearningare and how these concerns can be managed. The paper concludeswith an analytical-descriptive method that the creators of scientific, literaryand artistic works in the process of E-Learning can manage the secondaryuses by using the technologies resulting from the Digital Rights Managementand block chain. Nevertheless, exceptions to intellectual property rights canimpose rights and privileges in the public interest. In the meantime, theadoption of the 2019 EU Directive on Copyright, Marrakesh Treaty and thejurisprudence of some countries will play a vital role in establishing the rightof users to access knowledge in critical situations such as Corona Pandemicand other infectious diseases. In addition, open access promoters have madea significant contribution to meeting public needs.
