عنوان فارسی بررسی تحلیلی ماهیت مصوبات شورای عالی انقلاب فرهنگی
چکیده فارسی مقاله  چکیدهماهیت مصوبات شورای عالی انقلاب فرهنگی در نظام حقوقی، همواره ذهن برخی را به خود مشغول داشته و بحث در خصوص ماهیت و جنس مصوبات این نهاد همچنان محل بحث است. بر این اساس، پرسش اصلی این است که آیا مصوبات شورای عالی انقلاب فرهنگی از نوع سیاست‌گذاری است یا قانون‌گذاری و یا مقرره‌گذاری؟ با توجه به اینکه (1) سیاست‌گذاری تحت لوای حاکمیت قانون معنا می‌یابد، و (2) قانون‌گذار دانستن شورای عالی متضمن نفی صلاحیت انحصاری مجلس در امر تقنین است، و همچنین (3) اِعمال اختیار مقرره‌گذاری بنابر صلاحیت‌های اعطاشده قابل توجیه است. بعید به نظر می‌رسد که بتوان مصوبات این نهاد را تحت این سه عنوان نام‌گذاری کرد و برای آ­ن­ها اثری حقوقی متصور شد. در این نوشتار کوشیده‌ایم با نگاهی به تعاریف موجود در مورد سه عمل یادشده و از منظری سلبی، عدم قابلیت انطباق این مفاهیم بر مصوبات شورای عالی انقلاب فرهنگی را با استناد به مصوبات این نهاد نشان دهیم. کلید واژگان:سیاست‌گذاری، شورای عالی انقلاب فرهنگی، صلاحیت، قانون‌گذاری، مقرره‌گذاری.

عنوان انگلیسی Analytical study of the nature of the regulations of the Supreme Council of Cultural Revolutio
چکیده انگلیسی مقاله Abstract The nature of the regulations of the supreme council of cultural revolution in the legal system and hierarchy of law sources, have preoccupied some researchers and the recognizing the status of these regulations seems necessary. Therefore, there have been expressed diverse views about the nature of the regulations by scholars to answer this question that whether the nature of these regulations is policymaking, lawmaking or rulemaking? with regard to this issue that the policymaking is based on the principle of rule of law and predetermined competence of legislature from one side and as well as if we consider this council as a lawmaker institution, we contradict the exclusive competence of parliament in legislating on the other hand, and also with regard to this issue that the devolution of competence for rulemaking is in the legislature competence, therefore it seems unlikely to consider the regulations of the council as one of the aforementioned titles and imagine legal effect for them. Therefore, in this paper I attend to clear the nature of this regulations and I'll try to with regard to the council's regulations examine this issue that whether these regulations are adaptable to these notions (policy making, lawmaking and rulemaking) or not?
