عنوان فارسی نقش ارتباط در صحت توافق انتخاب دادگاه
چکیده فارسی مقاله امروزه توجه به حاکمیت ارادۀ اشخاص در حوزۀ حقوق بین‌الملل خصوصی هم در قوانین ملی برخی کشورها و هم معاهدات بین‌المللی مرتبط مشهود است. یکی از دستاوردهای چنین رویکردی، اعتبار و نفوذ توافق بر صلاحیت یا توافق‌نامه‎های انتخاب دادگاه در اغلب نظام‌های حقوقی دنیاست. گرچه در خصوص رعایت شرایط عمومی صحت قراردادها در انعقاد توافق صلاحیت تقریباً اختلافی مشاهده نمی‌شود، یکی از ابهامات مهم در خصوص این توافق این است که آیا برای صحت چنین توافق‌هایی باید میان دادگاه منتخب طرفین و دعوایی که دادگاه منتخب می‌خواهد به آن رسیدگی نماید، ارتباط وجود داشته باشد یا خیر؟ به عبارت دیگر، آیا شرط ارتباط جزء شرایط صحت چنین توافقی محسوب می‌شود؟ مقالۀ حاضر با روش توصیفی، تحلیلی و با رویکرد تطبیقی و با بررسی مقررات ملی و بین‌المللی در این حوزه و بررسی مقررات ایران نشان می‌دهد که رویکرد کلی در جهان، عدم لزوم شرط ارتباط بوده و قانون‌گذار ایران نیز به طور غیرمستقیم از همین رویکرد پیروی نموده است.

چکیده انگلیسی مقاله The Role of Connection in Choice of Court Agreement Validity Mohammed mjed Kabry (M.A in Private Law, Department of Private Law, Ferdowsi University of Mashhad) Azam Ansari (Assistant Professor, Department of Private Law, Ferdowsi University of Mashhad) Abstract Nowadays, the Party autonomy principle in the private international context is respected under domestic law of some countries and related international conventions. The enforceability of jurisdiction agreements or choice of court agreements in many legal systems is one of party autonomy principle’s results. Although, there is not any doubt that the jurisdiction agreement must meet the essential conditions for the validity of a contract, there is an important challenge to require the connection between the chosen court and the dispute. On the other words, it is questionable whether the connection between the chosen court and the dispute is necessary for the enforceability of jurisdiction agreements? This essay with descriptive-analytical and comparative approach with considering the domestic laws and related international instruments shows that the connection between the chosen court and the dispute is not required for the validity of such an agreement. This approach has been accepted universally and also has followed by the Iranian lawmaker indirectly. Keywords: Connection, Jurisdiction Agreement, Party Autonomy, Chosen Court, Competent Court
