عنوان فارسی نسبت قاضی با ایدئولوژی نظام سیاسی
چکیده فارسی مقاله پژوهش پیرامون استقلال قضایی ناخودآگاه ما را به سمت این سؤال سوق خواهد داد که قاضی به‌عنوان کارگزار نظام سیاسی چگونه می‌تواند نسبت به این نظام مستقل بماند. علقه‌ای که بین قاضی و نظام سیاسی وجود دارد تا چه حد قاضی را به تبعیت از تصمیمات نظام سیاسی ملزم می‌کند. در این نوشتار، ضمن بیان اقتدار قاضی و نیز رابطۀ استخدامی قاضی با دستگاه قضایی به‌عنوان یکی از ارکان سه‌گانه دولت ملّی به‌مثابه علقه‌های وابستگی قاضی به نظام سیاسی از قانون و قواعد حقوقی به‌عنوان تیغی دو لبه یاد شده است که هم یادآور وابستگی قاضی است و هم ابزار اعلام استقلال او از نظام سیاسی. با بیان ماهیت خاص عمل قضایی و تمایز آن از سایر اعمال کارگزاران سیستم و نیز تفکیک رفتار کارگزاران نظام سیاسی با تمامیت آن، راه تعادل برای قضات در حفاظت از استقلال خود بیان شده است. نهایتاً استفاده از صلاحیت تفسیری و نیز مناسبات حاکمیت قانون، بهترین راه ایجاد تعادل در ارتباط قاضی با نظام سیاسی اعلام شده است.

چکیده انگلیسی مقاله Research on judicial independence will subconsciously lead us to the question of how a judge, as the agent of the political system, can remain independent of this system. To what extent does the interest between the judge and the political system require the judge to follow the decisions of the political system? In this article, while expressing the authority of the judge and the judge's employment relationship with the judiciary as one of the three pillars of the nation-state as the reasons for the judge's dependence on the political system, the law and legal rules are mentioned as two-edged razor blades. It is reminiscent of the judge's dependence and the means of declaring her independence from the political system. By stating the specific nature of judicial action and distinguishing it from other actions of system agents, as well as distinguishing the behavior of agents of the political system with its whole, the way to balance for judges in protecting their independence is stated. Finally, the use of interpretive jurisdiction as well as the rule of law is the best way to balance the judge's relationship with the political system.
