عنوان فارسی مبانی و جلوه های تأثیر اقتصاد سیاسی بر سیاست‌گذاری کیفری در ایالات‌متحده
چکیده فارسی مقاله «آمریکایی شدن رویکردهای جنایی» جریانی است بین‌المللی که همگام با هژمونی مدل‌های کیفرگذاری کشورهای غربی، بر کشورهای در حال توسعه سایه افکنده و به جنبشی فراگیر تبدیل گشت. قانون‌گذاران و سیاست‌گذاران کشورهای در حال توسعه با این تلقی نادرست که سیاست‌های کیفری در ایالات‌متحده مبتنی بر مبانی متقن کیفرشناختی بوده و از رهگذر جریانات فکری-فلسفی عبور کرده‌اند، اقدام به اقتباس حداکثری از این سیاست‌ها می‌نمایند. این اشتباه راهبردی در شرایطی صورت می‌گیرد که بخش قابل‌توجهی از تبیین‌هایِ متعارف و البته انتقادی از حقوق کیفری در آمریکا، تحولات سیاست‌گذاری کیفری معاصر در این کشور را تابعی از فاکتورهای اجتماعی-عوامل غیرمعرفتی- و نه جریانات فلسفی و علمی می‌دانند. تعمق در سیاست‌های کیفری نشان می‌دهد که در بین فاکتورهای اجتماعی مذکور، گستره نفوذ «اقتصاد سیاسی» بیش از هر عامل دیگری بوده است.نوشتار حاضر با بررسی مبانی نظری و نیز ریشه‌های سیاست‌های کیفری معاصر در ایالات‌متحده اثبات می‌نماید که بخش قابل‌توجهی از این سیاست‌ها نه‌تنها فاقد وجاهت علمی و مبانی متقن کیفرشناختی بوده، بلکه تحت تأثیر جریان اقتصاد سیاسی و با هدف تحصیل منافع سیاسی و اقتصادی صورت پذیرفته است. تصویر ارائه‌شده در این نوشتار با استفاده از داده‌های کمی و مطالعات تاریخی، نقش لابی‌ احزاب سیاسی و بنگاه‌های اقتصادی‌ای مانند صنایع اسلحه‌سازی، صنایع نظامی و شرکت‌های امنیتی-اطلاعاتی در سیاست‌‌‌گذاری کیفری معاصر آمریکا را تبیین نموده و با تحلیل انتقادی سیاست‌هایی مانند مجموعه سیاست‌های کنترل جرم، سیاست‌های مقابله با تروریسم، سیاست‌های عدم تسامح و مجازات زندان فرایند آمریکایی شدن رویکردهای جنایی را به چالش می‌کشد.

عنوان انگلیسی Principles and effects of impact of Political Economy on Criminal Policy in the United States
چکیده انگلیسی مقاله "The Americanization of Criminal Approaches" is an international movement that,in keeping with the hegemony of the Western world's penalization models,shadowed the developing world and turned into a comprehensive and universal movement. Legislators and policy makers in developing countries are adopting the maximum of these policies, with the false perception that criminal policies in the UnitedStates have been based on pseudo-psychological principles and through intellectual-philosophical processes. This strategic mistake occurs in a situation where a significant part of the conventional and critically accountable explanations of criminal law in the UnitedStates consider the development of contemporary criminal policy in the country as a function of social factors, non-lethal factors not philosophical or scientific trends. Meditations on criminal policy show that among the above-mentioned social factors,the extent of the influence of "political economy" has been more than any other factor. This paper, by examining the theoretical foundations and the roots of contemporary criminal policy in the United States, proves that a significant portion of these policies not only lacked the scientific and fundamental principles of cognitive science,but also was influenced by the flow of political economy and the pursuit of political and economic interest. The image presented in this paper, using quantitative data and historical studies,explains the role of the lobbying of political parties and economic enterprises such as the arms industry, military industries,and intelligence companies in contemporary US criminal policy,and analyzes critical policies such as crime control policies, Counter-terrorism policies, non-alignment policies, and prison sentences, the American process challenges the criminal approach.
