عنوان فارسی بررسی فقهی و حقوقی تعدیل سلطه و انتظارات زوج از زوجۀ شاغل در مسئلۀ تمکین وخروج ازمنزل
چکیده فارسی مقاله شرع مقدس اسلام و به تبعیت از آن مادۀ 1105 قانون مدنی ایران ریاست خانواده را بر عهدۀ زوج نهاده و حسب مفاد 1108همان قانون زوجه ملزم به تمکین از زوج شده است؛ از طرفی با تغییر الگوهای زندگی بشری در جهان معاصر و روی آوردن زنان به تکالیف و مشاغل اجتماعی، تمکین از زوج در هر زمانی برای آنان میسر نیست. یافته‌های پژوهش بیانگر آن است که خروج بدون اذن زوجه از منزل مغایر با تمکین از زوج تلقی می‌شود و حکم آن همواره مورد اختلاف فقیهان بوده است. محقق با استفاده از روش توصیفی و تحلیلی بر این عقیده تأکید می‌ورزد هرچند تمکین در زندگی زناشویی از آثار اساسی و مطلوب عقد نکاح است، در ذات عقد نکاح لحاظ نشده است، بلکه مقتضای اطلاق عقد نکاح است و مصداقی از حقوق زوج بر ذمۀ زوجه محسوب می‌شود، ازاین‌رو زنان شاغل که ناچار به خروج از منزل هستند، برای پیشگیری از هرگونه مشاجرات احتمالی پس از عقد نکاح می‌توانند پیش از ازدواج مطابق خواستۀ خود بر سر مسئلۀ زمان تمکین با زوج خود توافق کنند.

عنوان انگلیسی Jurisprudential and Legal Study of Adjusting the Domination and Expectations of the Husband from the Employed Wife on the Issue of Obedience and Leaving the House
چکیده انگلیسی مقاله The holy law of Islam (shari'a) and consequently Article 1105 of the Iranian Civil Code h::as char::ged the husband with the duty of leading the family. According to the provisions 1108 of the same law, the wife is obliged to obey the husband. On the other hand by changing the patterns of human life in the contemporary world and the women’s inclinations toward social businesses and duties, obedience to the husband is not possible for them at any time. The findings of the study indicate that leaving the house without the wife's permission is contrary to the obedience of the husband and the jurists have been always disagree with this matter. The researcher, using descriptive and analytical method, emphasizes this idea. Although obedience in marital life is one of the basic and desirable effects of marriage, it is not inherent in the marriage contract, but it is requirement of the marriage contract and it is considered as an example of husband's rights to his wife. Therefore, working women who are forced to leave home can agree on the issue of the time of obedience with their husband before marriage according to their wishes in order to prevent any possible disputes after marriage contract.
