عنوان فارسی بازپژوهی معنای تغییر احکام شرعی و عوامل مؤثر بر آن
چکیده فارسی مقاله بحث از امکان و چگونگی تغییر احکام فقهی در دهه­های اخیر مورد توجه جریان­های فکری مختلفی قرار گرفته و متفکرانی با مبانی و انگیزه­های متباین به آن پرداخته­اند. مسئله­­­ی اساسی در این تحقیق، تبیین دقیق معنای «تغییر حکم» و تحلیل سازکارهای وقوعِ آن است؛ به گونه­ای که روشن شود آیا این نام­گذاری، دقیق و حقیقی است یا تسامحی و مجازی؟ آثار نامطلوب برداشت­های نادرست از معنا و عوامل تغییر احکام، به ویژه شبهه­ی موقتی بودن احکام شرعی، ضرورت تحقیق در این مورد را روشن می­سازد. طبق نتایج به دست­آمده، عواملی چون تغییر ماهوی موضوع، تغییر اوصاف موضوع، تغییر عنوان مأخوذ در موضوع، تغییر علت حکم و... می توانند ـ اصطلاحاً ـ منجر به تغییر حکم شوند؛ البته تمام این عوامل تحت عنوان جامع «تغییر موضوع» قرار دارند. بر این اساس، اصطلاح تغییر احکام دارای تسامح است و آنچه در واقع رخ می­دهد این است که همه­ی احکام ثابت شرع در پی تحقق کامل موضوع خود فعلیت می­یابند و با خلل یافتن موضوع، حکمِ قبل از فعلیت افتاده و حکم ثابت دیگری فعلیت می­یابد. نتیجه­ی یاد شده افزون بر کاربرد کلامی در پاسخ­گویی به برخی شبهات، درک روشن­تری را از هم­پوشانی تغییر حکم و تغییر موضوع، فراروی پژوهشگران قرار می­دهد.

عنوان انگلیسی Reflection on the meaning of the change in religious law and its influencing factors
چکیده انگلیسی مقاله The discussion on the possibility and how to change the juridical instructions has attracted the attention of different intellectual currents and scholars have investigated it through different basics and motivations. The basic issue in this study is to explain the accurate meaning of “changing instruction” and analyzing the mechanisms of its venue; so that it clarifies whether this nomination is accurate and real or it is tolerant or virtual? The undesired effects of incorrect understanding of meaning and factors of changing instructions, especially the doubt on religious instructions temporality clarify the necessity to conduct such study. According to the results, factors including changing subject substantially, changing subject descriptions, changing the title of derivative in subject, changing the reason of instruction and…may –idiomatically- lead to the change of instruction; but all these factors are under the comprehensive title of “changing subject”. Accordingly, the expression of instructions change has tolerance and what happens in reality is that all fixed instructions of sharia are activated following the comprehensive achievement of their subject and by subject being disrupted, the previous instruction becomes inactivated and another fixed instruction activates. The mentioned result besides the verbal application in answering some doubts, offers a clearer understanding of overlap between instruction change and subject change before researchers.
