عنوان فارسی کنترل حرفه پزشکی از رهگذر قواعد رفتار حرفه ‌ای (مطالعه تطبیقی رویکرد آلمان و امریکا)
چکیده فارسی مقاله کنترل نظام‏های حرفه‏ای و صنفی در قالب نظارت قیمومتی همیشه مطرح است. لیکن امکان کنترل این نهادها بر مبنای وضع پاره‏ای استانداردهای حرفه‏ایِ مبتنی بر خودگردانی نیز ممکن است. حرفه پزشکی به دلیل ارتباط با مهم‏ترین جنبه‏های حیات بشری از حساسیت ویژه‏ای برخوردار است و تلاش می‏شود، عملکرد اعضای آن مشمول استانداردهای حرفه‏ای قرار گیرد که گاهی توسط مراجع دولتی و در کالبد قواعد اخلاقی به تصویب می‏رسند. منتها در کشورهایی چون آلمان و امریکا، نظام‏های پزشکی مبادرت به وضع این استانداردها در قالب قواعد رفتاری می‏کنند. قواعد رفتار حرفه‏ای در مقایسه با قواعد اخلاقی از تعیّن بیشتری برخوردار بوده و واجد پاره‏ای از ضمانت‏های اجرایی می‏باشند و لذا از قدرت الزامی برخوردارند. پرسش این است که در آلمان و امریکا، استانداردهای حرفه‏ای پزشکان چه وضعیتی دارد؟ از آنجا که تکالیف مندرج در قواعد رفتاری پزشکان دو کشور، به‌طور دقیق نحوه عملکرد پزشکان را تبیین و برای تضمین رعایت آن‏ها ضمانت‏اجرا پیش‏بینی شده، لذا قواعد مزبور در قالب حقوق نرم واجد الزام حقوقی تلقی می‏شوند. هدف این مقاله، تبیین تکالیف رفتاری پزشکان و ضمانت‏اجراهای آن به مثابه بخش مهمی از قواعد رفتار حرفه‏ای است تا دریابیم که مصوبات نهادهای حرفه‏ای پزشکی نیز با لحاظ پاره‏ای شرایط، الزام‏آور بوده و قادر به کنترل رفتار پزشکان هستند. در این راستا با استفاده از کدهای رفتاری، کتب و مقالات، به شیوه‏ای توصیفی- تحلیلی درصدد این هدف هستیم. یافته‏ها نشان می‏دهد که به‌رغم پیش‏بینی بعضی تکالیف رفتاری مانند رازداری در دو کشور، رویکرد آلمان نسبت به وضع تکالیف رفتاری و ضمانت‏اجراها دقیق‏تر و در راستای خودگردانی حرفه‏ای است.

عنوان انگلیسی Control of the Medical Profession through the Professional Codes of Conduct (Comparative Study of the Approach of Germany and America)
چکیده انگلیسی مقاله Control of professional and guild institutions in the form of the administrative guardianship is always important. However, it is also possible to control these institutions by setting some professional standards based on autonomy. The medical profession has a special sensitivity due to its connection with the most important aspects of human life and making an effort to bring the performance of its members subject to professional standards which are generally adopted by governmental authorities in the form of codes of ethic. Although, in countries such as Germany and the United States of America, medical :union:s set these standards in the form of codes of conduct. The professional codes of conduct are more definite than the codes of ethic and have some sanctions and therefore have the mandatory power. The question is, what is the status of physicians' professional standards in Germany and the United States of America? Because the duties contained in the physicians' codes of conduct of Germany and the United States of America precisely explain how physicians perform and to ensure compliance there are some sanctions, so these codes in the form of soft law have a legal obligation. The purpose of this article is to explain the physicians' behavioral duties and its sanctions as an important part of the professional codes of conduct to find out that the regulations of professional medical institutions are binding in some conditions and are able to control physicians' conduct. In this regard, we have used codes of conduct, books and articles and we are trying to achieve this goal in a descriptive-analytical manner. The findings show that despite the prediction of some behavioral duties such as confidentiality in Germany and the united states of America, the German approach to enact of behavioral duties and sanctions is more exact and in accordance with professional autonomy.
