عنوان فارسی درنگی در ممنوعیت ازدواج مرد مسلمان با کافر غیرکتابی
چکیده فارسی مقاله بر اساس فتوای مشهور بلکه اجماعی در میان فقهای اسلام، ازدواج مرد مسلمان با زنان کافر غیر اهل کتاب، جایز نیست. هرچند این فتوا، مبتنی بر دلیل‌های مستحکمی مانند برخی از آیات قرآنی، اجماع و شماری از روایات است، ولی به نظر می‌رسد مورد این دلیل‌ها، زنانی است که به کفر و شرک اعتقاد دارند و خود را نسبت به عقاید کفرآمیز و مشرکانه، متدین می‌دانند و از زنان فراوانی که اسلام و نیز ادیان دیگر را نمی‌شناسند و نسبت به دین حق، دشمنی نمی‌ورزند و به تعبیر روایات «مستضعف» محسوب می‌شوند، انصراف دارند و بر همین اساس، می‌توان دست کم، در موارد عسروحرج، ازدواج مرد مسلمان با این‌گونه زنان و نیز باقی ماندن مرد تازه مسلمان بر ازدواج با آنان را جایز دانست.

عنوان انگلیسی A Contemplation on the Prohibition of the Marriage of a Muslim Man to an Unbelieving Woman of No Book
چکیده انگلیسی مقاله According to the famous or, better said, the unanimous judicial decree (fatwa) of the Muslim jurists, the marriage of a Muslim man to an unbelieving woman who adheres to any faith other than those of the People of the Book (ahl al-kitāb) is prohibited. Although this judicial decree is based on definite evidences such as certain verses of the Qur’an, consensus of the jurists, and a number of traditional narratives, it seems the women meant by these sources are those who believe in infidelity (kufr) and polytheism (shirk) and consider themselves as devotees to pagan and profane cults. Thus this judicial decree leaves out those many women who are not familiarized with Islam and other [Abrahamic] religions and have no animosity toward the True Religion, and as described by traditional narratives, are considered helpless (mustaḍ‘af). Therefore, at least in cases of distress and constriction, one can identify the marriage of a Muslim man to such a woman, and also the subsistence of the marriage of a newly converted Muslim man to his wife, as permissible.
