عنوان فارسی رفع تقابل بین حق آزادی بیان و اطلاعات با حق بر داده‌ها‌ی شخصی در رسانه‌ها از منظر حقوق اتحادیه اروپا و نظام حقوقی ایران
چکیده فارسی مقاله احترام به حقوق و آزادی‌های اساسی بشر برای تداوم حیات هر جامعه‌ مردم‌سالار، امری ضروری است. به‌همین‌دلیل در صورتی‌ که حقوق اساسی مقابل هم قرار گیرند، باید به چگونگی برقراری تعادل بین آنها ‌اندیشید و نمی‌توان به‌طور کامل از یک حق به دلیل وجود چنین تقابلی چشم‌پوشی کرد. از این موارد می‌توان به تزاحم بین حق آزادی بیان و اطلاعات با حق حفاظت از داده‌های شخصیِ اشخاص حقیقی در رسانه‌ها و مطبوعات اشاره کرد. توضیح اینکه متصدیان رسانه‌ها و مطبوعات در انتشار اخبار با طیف وسیعی از داده‌های شخصی در ارتباط هستند؛ آنان در همان ‌حال ‌که باید به‌طور مناسب و شفاف به شهروندان اطلاع‌رسانی کنند؛ نباید حق بر داده‌ افراد را مورد تعرض قرار دهند. از‌این‌رو، چگونگی تحقق این امر در مقام عمل نیاز به چاره‌جویی دارد. پژوهش حاضر، به دلیل جستجوی پاسخ این مسئله از منابع حقوقی اتحادیه اروپا و سپس بررسی آن در نظام حقوقی ایران، ماهیتی توصیفی ـ تحلیلی و تطبیقی دارد. روش پژوهش نیز اسنادی و کتابخانه‌ای است؛ به‌این‌ترتیب در پژوهش حاضر، اسناد مختلفی ازجمله اسناد قانونی نظام‌های حقوقی پیش‌گفته مورد بررسی قرار گرفته است. مطالعات صورت گرفته حکایت از این دارد که رسانه‌ها و مطبوعات زمانی می‌توانند مطابق با حق آزادی بیان و اطلاعات رفتار کنند که منافع عمومی، سرشناس بودن شخص موضوع خبر و ضرورت افشای آن با هدف شفاف‌سازی افکار عمومی، همچنین اطمینان از صحت اطلاعات و کسب آن از منبعی معتبر، را به‌صورت توأمان در نظر گرفته باشند.

چکیده انگلیسی مقاله Respect for basic human rights and freedoms are necessary for the survival of any democratic society. For this reason, if fundamental rights are opposed to each other, one should think about how to establish a balance between these rights, and one cannot completely ignore a right due to the existence of such a conflict. Among these cases, we can mention the conflict between the right to freedom of expression and information with the right to protect the personal data of natural persons in the media and press. It should be noted that media and press operators are in contact with a wide range of personal data in publishing news; while they should inform the citizens properly and transparently; People's data rights should not be violated. Therefore, how to realize this in practice should be resolved. The current research has a descriptive-analytical and comparative nature due to the search for the answer to this problem from the legal sources of the European :union: and then its investigation in the legal system of Iran. The research method is documentary and library; In this way, in the current research, various documents, including the legal documents of the aforementioned legal systems, have been examined. The conducted studies indicate that the media and the press can act in accordance with the right to freedom of expression and information when there is public interest in a news item, the celebrity of the subject of the news and the need to disclose this news in order to clarify public opinion, as well as ensure the accuracy of the information. and acquiring it from a reliable source should exist in tandem.
