عنوان فارسی تحلیل واژگانی گفتمان نظارت در نظام حقوقی ایران؛ با تأکید بر روش دیرینه‌شناسی فوکو
چکیده فارسی مقاله «نظارت»، به‌مثابۀ گفتمان بنیادی در حقوق عمومی، شالودۀ نظام‌های حقوقی مدرن را بنا می‌نهد. حتی می‌توان مدعی شد مهمترین کارویژۀ دولت حقوقی، یعنی تضمین و حمایت از حقوق و آزادی‌های شهروندان، نیز از رهگذار نظارت محقق می‌شود. با این همه، تعدد واژگانی نظارت و مآلاً ابهام در شناخت ابعاد و کارکردهای چندوجهی این گفتمان، تدقیق در «منظومۀ واژگانی نظارت» را ضروری ساخته است. از همین‌رو، پرسش اصلی این مقاله آن است که «منظومۀ واژگانی گفتمان نظارت در نظام حقوقی ایران کدام‌اند؟» برای پاسخ به این پرسش با روش کیفی مبتنی‌بر دیرینه‌شناسی فوکویی و گردآوری داده‌ها از طریق کتابخانه‌ای تلاش گردید تا با تأکید خاص بر «اُبژه» در تحلیل گفتمان نظارت از میان چهار عنصر دیرینه‌شناختی فوکویی _«اُبژه»، «سوژه»، «مفاهیم» و «استراتژی»_، منظومۀ واژگانی نظارت در سه سطح «لغوی»، «اصطلاحی» و «مصادیق عملی آن در نظام حقوقی ایران» مورد بررسی قرار گیرد. یافته‌های این پژوهش نشان می‌دهد نخست می‌توان از میان واژگان متعدد متناظر با نظارت، هشت کلیدواژۀ مهم را برجسته ساخته و با تدقیق در معانی لغوی، اصطلاحی و کاربست عملی، به استفادۀ زبانی دقیق از آن‌ها در بافتار مناسب خود مبادرت ورزید. همچنین می‌توان منظومۀ واژگانی نظارت را مبتنی‌بر استنباط لغوی و اصطلاحی به‌دست‌آمده، بر اساس دو مؤلفۀ مهم «عمق» _شامل منظومۀ واژگانی کم عمق و عمیق_ و «ماهیت» _شامل اداری (اعم از مالی و انتظامی)، سیاسی و قضایی_ طبقه‌بندی نمود و از این رو، برخی کاربست‌های زبانی ناصواب در نظام حقوقی ایران را نمایان ساخت.

عنوان انگلیسی Lexical analysis of surveillance discourse in Iran's legal system; Emphasizing Foucault's paleontological method
چکیده انگلیسی مقاله "check", as a fundamental discourse in public law, builds the foundation of modern legal systems. It can even be claimed that the most important function of the legal government, i.e. guaranteeing and protecting the rights and freedoms of citizens, is also realized through check. However, the multiplicity of check vocabulary and the ambiguity in understanding the dimensions and multifaceted functions of this discourse have made it necessary to clarify the vocabulary of check. Therefore, the main question of this article is "What are the lexical systems of check discourse in Iran's legal system?" In order to answer this question, with a qualitative method based on Foucaultian paleontology and data collection through a library, an effort was made to analyze the discourse of check with special emphasis on "object" among the four Foucaultian paleontological elements - "object", "subject", "concepts" and "Strategy", the lexical system of monitoring at three levels, "lexical", "terminological" and "its practical examples in Iran's legal system" should be examined. The findings of this research show that firstly, eight important keywords can be highlighted from among the many words corresponding to check and by checking the lexical, idiomatic and practical meanings, they can be used in a precise language in their appropriate context. It is also possible to classify the check lexical system based on the lexical and terminological inference obtained, based on two important components "depth" - including shallow and deep lexical system - and "substance" - including administrative (both financial and policing), political and judicial - and from this Row revealed some inappropriate language usages in Iran's legal system.
