چکیده فارسی مقاله حقوق دریاها همواره امکان حل و فصل رویکردهای متناقض به موضوعات مبتلابه در دریا را فراهم نموده و اطمینان حقوقی در آزادی خطوط کشتیرانی در دریای آزاد را تضمین می‌کند. اگرچه برخی دولت‌ها رویکردی متنقاضی در این امر داشته باشند اما در نهایت می‌بایستی به قواعد حقوقی چه از نوع قراردادی و چه عرفی احترام بگذارند. نیروی دریایی راهبردی ارتش جمهوری اسلامی ایران در راستای تامین منافع ملی، بین‌امللی و تامین امنیت دریایی (مبارزه با دزدان دریایی و تروریسم دریایی)، حمایت از خطوط کشتیرانی تجاری کشور و ... و نیز براساس راهبرد تعیین شده در ساختار حاکمیتی جمهوری اسلمی ایران و به استناد اسناد بالادستی و در چهارچوب حقوق بین‌الملل دریاها، در عرصه آب‌های بین‌المللی حضور یافته است. اما در این بین برخی از کشورها از قبیل؛ آمریکا، استرالیا، فرانسه و ... تلاش داشته‌اند در راستای جلوگیری از حضور نیروی دریایی ارتش در آب‌های بین‌المللی، به‌ویژه ماموریت ناوگروه 360 با تفسیر دوگانه از قواعد حقوق بین‌الملل دریاها و اعمال سیاست‌های تحریمی از این حضور ممانعت به‌عمل آورند. ازاین‌رو هدف از این تحقیق بررسی قواعد حاکم بر آزادی دریانوردی در دریای آزاد، و ‌بررسی عملکرد نیروی دریایی ارتش جمهوری اسلامی ایران از اقیانوس هند تا اجرای ماموریت ناوگروه 360 می‌باشد، که این مختصر تلاش می‌دارد به این سوال که آیا عملکرد نیروی دریایی ارتش جمهوری اسلامی ایران از اقیانوس هند تا ماموریت ناوگروه 360 در چهارچوب حقوق بین‌الملل دریاها بوده است؟ پاسخ دهد. روش تحقیق نوشتار حاضر روش توصیفی تحلیلی، و روش جمع‌آوری اطلاعات روش کتابخانه‌ای-استنادی می‌باشد. براساس یافته‌های تحقیق، علیرغم تلاش‌های نافرجام و نقض قواعد حقوق بین‌الملل از سوی آمریکا و دیگر کشورهای هم‌پیمان آن، عملکرد جمهوری اسلامی ایران با رعایت و احترام به قواعد حقوق بین‌الملل دریاها بوده و ماموریت‌های مذکور را با اقتدار در عرصه بین‌المللی به‌اجرا در آورده است.

چکیده انگلیسی مقاله Law of the seas always provides the possibility of resolving conflicting approaches to issues at sea and guarantees legal certainty in the freedom of shipping lines in the high seas. Although some governments have a conflicting approach in this matter, in the end they must respect the legal rules, both contractual and customary. Strategic Navy of the Army of the Islamic Republic of Iran in the direction of securing national and international interests and providing maritime security , supporting the commercial shipping lines of the country, etc. and also based on the strategy determined in the governance structure of the Iran has been present in the field of international waters based on upstream documents and within the framework of the international law of the seas. But in the meantime, some countries such as; America, Australia, France, etc. have tried to prevent the presence of the army navy in international waters, especially the mission of the 360 fleet with a double interpretation of the rules of international law of the seas and the application of policies Sanction to prevent this presence. Therefore, the purpose of this research is to examine the rules governing the freedom of navigation in the open sea, and to examine the performance of the Islamic Republic of Iran Navy from the Indian Ocean to the implementation of the 360 flotilla mission, which briefly tries to answer the question that Has the performance of the Navy of the Islamic Republic of Iran from the Indian Ocean to the mission of the 360 flotilla been within the framework of the international law of the seas? to answer The research method of this article is descriptive analytical method, and the method of collecting information is library-reference method. According to the findings of the research, despite the unsuccessful efforts and violation of the rules of international law by the United States and other allied countries, the performance of the Islamic Republic of Iran has been in compliance with and respect for the rules of international law of the seas, and the aforementioned missions has implemented with authority in the international arena.
