عنوان فارسی اثبات نظریه افتراق معنوی در خیار مجلس‌
چکیده فارسی مقاله با توجه به پیشرفت فناوری و ظهور روش‌های نوین دادوستد برای رفاه هر چه بیشتر بشر، پذیرش و عدم پذیرش نظریه اجتماع و افتراق معنوی در خیار مجلس از جمله موضوعاتی است، که نقش به سزایی بر حفظ حقوق مکتسبه افراد در زیست اجتماعی دارد. در گذشته با توجه به شکل روش‌های کهن معاملاتی استدلال در مسیر موضوعیت داشتن اجتماع و افتراق فیزیکی در خیار مجلس قرار می‌گرفت، و رفته رفته با پیدایش معاملاتی نظیر عقود تلفنی، اینترنتی و . موضوعیت داشتن ارتباط فکری نیز از سوی برخی از صاحب نظران مطرح شد؛ حال در خصوص از بین رفتن این ارتباط فکری به روش توصیفی – تحلیلی، مطابق آیاتی که دلالت بر اهمیت قصد و اراده طرفین و تاکید بر اصاله اللزوم درعقود دارند، با جمع میان اخبار متعارض و توجیه مستدل روایت متعارض به افتراق معنوی در همراهی بنای عقلاء، همچنین تمسک به قیاس اولویت و حکم عقل، نظر جدیدی تحت عنوان افتراق معنوی در خیار مجلس مبتنی بر ارتباط فکری ثابت می‌شود، که بنا به اثبات و پذیرش این نظریه در صورت برهم خوردن ارتباط فکری طرفین با وجود اجتماع فیزیکی ایشان، افتراق که غایت از بین رفتن خیار مجلس است، به خاطر موضوعیت نداشتن اجتماع و افتراق فیزیکی، محقق می‌شود.

عنوان انگلیسی Proof of Spiritual Distinction Theory in Meeting-place Option (khiyār-i majlis)
چکیده انگلیسی مقاله Considering the technology advancement and emergence of new trading methods for the greater welfare of humankind, the acceptance and non-acceptance (rejection) of the theory of :union: and spiritual distinction in meeting-place option (khiyār-i majlis) are among the issues that play a significant role in preserving the acquired rights of individuals in social life. In the past, arguments were placed in the meeting-place option regarding the relevance of :union: and physical distinction according to the form of the old trading methods, and gradually, with the emergence of transactions such as telephone contracts, internet contracts, etc. the topic of having an intellectual relationship was also raised by some experts. Now, the author uses a descriptive-analytical method regarding the loss of this intellectual relationship to prove a new claim under the title of the spiritual distinction theory in the meeting-place option based on intellectual connection, according to all the verses that indicate the importance of the intention and will of the parties and emphasis on the integrity and necessity of contracts, by reconciliation between conflicting traditions and justified justification of the conflicting narrative to the spiritual distinction in companionship of intellectuals procedure as well as resorting to the analogy of priority and the ruling of wisdom. According to the proof and acceptance of this theory in the event of disruption of the intellectual connection of the parties despite their physical :union:, the distinction, which is the end of the destruction of the meeting option, is realized due to the lack of objectivity of the physical distinction and :union:.
