عنوان فارسی نگاه انتقادی به دیدگاه عدمحجیت تقریر
چکیده فارسی مقاله تقریر معصوم، ارتباط تنگاتنگی با عدمِ‌ردع در سیرهٔ عقلا دارد؛ این تقریر، گاه بر فعل مکلف و گاه بر سیرهٔ عقلایی است. استدلال به سیره در مسائل مختلف اصولی و ابوابی از فقه معاملات کاربرد وسیعی یافته است. اصولیان دربارهٔ حجیتِ تقریر وحدتِ‌نظر یافته‌اند و رویکرد عدم‌حجیت تقریر دیدگاه بدیعی محسوب و در برابر این تسالم اصولی شکل گرفته است. در نوشتار حاضر که به‌منظور بررسی و نقد این رویکرد با روش کتابخانه‌ای و توصیفی‌تحلیلی تدوین شده، از یک سو گزاره‌هایی چون قبح القاء در مفسده و تفویت مصلحت و ادله‌ای مانند لزوم ارشاد جاهل و روایات لزوم تبلیغ شریعت و ازسوی‌دیگر، روایاتِ عدم‌وجوبِ جواب بر امام(ع) و دیگر ادله در نظامی هماهنگ، تفسیر شده است.

عنوان انگلیسی A Critical Reading of the View on the Non-Authoritativeness of Taqrīr (Approval)
چکیده انگلیسی مقاله The Taqrīr of Maʿṣūm (approval of infallible) is closely related to the absence of prohibition (ʿadam-i radʿ) in the practices of scholars (Sīra). This approval is sometimes related to obligatory actions, and sometimes to the practices of scholars (Sīra). Reasoning using Sīra has become prominent in various issues of jurisprudential principles (Uṣūl) and chapters of transactional jurisprudence. Scholars of Uṣūlī jurisprudence (Uṣūlīs) have reached a consensus regarding the authority of Taqrīr. The view of non-authority of Taqrīr has been shaped in contrast to this established consensus and is a novel perspective. The present study is conducted using library research and the descriptive-analytical method and aims to analyze and critique this approach. On the one hand, propositions such as the abhorrence of causing corruption (Qubḥ al-ilqāʾ dar mafsada) and neglecting benefits (neglecting maṣlaḥat), and evidences such as the necessity of guiding the ignorant, and the narrations about the necessity of the propagation of the sharīʿa are explored. On the other hand, narrations indicating the non-obligation of responding to Imām (peace be upon him) and other evidences in a coordinated system are studied.
