عنوان فارسی مطالعۀتوزیع بهینۀ منابع در نظام عدالت کیفری جمهوری اسلامی ایران در پرتو تجارب سایر کشورها
چکیده فارسی مقاله محدودیت منابع مالی، مدیریت هزینه‌های روزافزون عدالت کیفری و بهینه‌سازی منابع تخصیصی به این نظام را ایجاب می‌کند. تحقق این امر مستلزم آن است که سهم کارآمد بخش‌های نظام عدالت کیفری تعیین و منابع تخصیصی به این نظام به صورت بهینه میان آن بخش‌ها تقسیم شود.

چهارچوب تحلیل در پژوهش حاضر، رویکرد اقتصادی به حقوق کیفری است.این مقاله با تکیه بر تحلیل اقتصادی داده‌های آماری عدالت کیفری سعی در ارائه‌ راهکار جهت بهینه‌سازی توزیع منابع در این نظام دارد.

برابر یافته‌های این پژوهش، یکی از اولویت های نظام عدالت کیفری کشور توجه به بحث اجرای مجازات است. با بازبینی و اصلاح سیاست-های کم‌بازده و پرهزینۀ عدالت کیفری و طراحی مجموعه‌ای از شاخص‌های عملکرد در حوزۀ زندان‌ها می‌توان ضمن تضمین قطعیت اجرای مجازات، بودجۀ این بخش را به نحو صحیح و بهینه مدیریت کرد. بودجۀ کلان تخصیصی به رسیدگی به جرایم در دادسرا و دادگاه‌های کیفری باید از طریق بازنگری در شاخص‌های عملکرد، کارآمد گردد. همچنین، از اهمیت پیشگیری از جرم نباید غافل شد و تخصیص بودجه به این حوزه باید براساس کم و کیف برنامه‌های پیشگیرانه صورت پذیرد. تخصیص بودجه به بخش‌های عدالت کیفری بر مبنای ارزیابی دقیق عملکرد آنها، افزون بر تقویت عملکردگرایی، سبب کارآمدی ساختار توزیع منابع میشود

عنوان انگلیسی Exploring the Optimal Distribution of Resources in the Criminal Justice System of the Islamic Republic of Iran Considering the Experiences of Other Countries
چکیده انگلیسی مقاله The optimization of resources allocated to the criminal justice system of the Islamic Republic of Iran depends on modifying the structure of resource distribution among different parts of this system and determining the optimal share of each section. Relying on economic approach to law and analysis of available data and statistics,the present study tries to provide a suitable solution for the optimal distribution of limited resources among the unlimited needs of the criminal justice system. The findings of this study show that paying attention to the court's budget and providing sufficient resources is a primary need. Also, it is necessary to pay more attention to the execution of the punishment.To reduce the costs of the criminal justice system, the certainty of punishment should not be impaired.By revising programs and policies of the criminal justice system based on cost and efficiency and reducing the use of high-cost, low-return policies, the costs of the system can be controlled. In addition, crime prevention should not be neglected. It is necessary to propose a set of performance indicators for courts and prison management. According to the performance of each section, which is evaluated based on the performance indicators, the optimal budget should be allocated. Consequently, in addition to greater attention to performance, the distribution of resources among different parts of the criminal justice system becomes efficient. Allocating resources to crime prevention should be based on the number of scientific preventive programs.
