عنوان فارسی قراءه فقهیه لطبیعه الشهاده المستنده إلی شیوع الخبر ونطاق إثباتها
چکیده فارسی مقاله الاستفاضه أو الشهاده المبنیه علی شیوع الخبر، تعنی انتشار خبر بین الناس بحیث یخبر عدد کبیر منهم به، مما یؤدی إلی تولد علم أو ظن قوی بمضمون الخبر. تُعتبر الاستفاضه إحدی طرق إثبات الدعوی فی الفقه الإمامی وفقه المذاهب الأربعه لأهل السنه وفی قوانین التقاضی فی العدید من الدول الإسلامیه. من حیث الطبیعه، یری بعض المفکرین أن الاستفاضه دلیل مستقل عن البینه تُستخدم فی حالات خاصه، بینما یعتبرها آخرون نوعًا من الشهاده لکن بدرجه اعتبار أقل من الشهاده الأصلیه وهی البینه. لم یتفق الفقهاء والقانونیون المسلمون علی الأمور التی یمکن إثباتها بالاستفاضه، وقد ذکروا أمورًا مثل النسب، الولاده، الموت، الولایه، الوقف، والزواج ضمن هذه الأمور. تشیر نتائج البحث إلی أنه نظرًا لعدم استناد هذه الآراء إلی دلیل قرآنی أو روائی موثوق، وبعباره أخری، نظرًا لکون هذا الإحصاء اجتهادیًا، یمکن تقدیم قاعده عامه مفادها: کل أمر یکون مشاهدته عند تحققه غالبًا صعبًا ولا یُعرف إلا عن طریق السماع من الآخرین؛ یجوز إثباته بناءً علی شهاده تسامعیه أو الاستفاضه، لأن إهمال الاستفاضه کدلیل وطریقه لإثبات مثل هذه الأمور قد یجعل إثباتها عملیًا صعبًا وربما مستحیلًا، مما یؤدی إلی ضیاع حقوق الآخرین.

Application is one of the ways to prove the dispute, which has a well-known position in Imami jurisprudence and the jurisprudence of the four Sunni religions. Regarding the nature of the application, the expressions of the jurists are different, and what is used in the statements of some jurists is that the application is an independent proof from the evidence with which certain cases are proved and from the words of some others. The jurists are used to say that there is a kind of testimony that is less valid than the original testimony. From the point of view of Islamic jurists, things that can be proved by interrogation are such things as lineage, birth, death, guardianship, endowment, marriage, etc. Will return. In addition, Shiite jurists have cited the Yunus sect as a reason for proving the authenticity of the usufruct, and many Sunni thinkers have cited Istihsan as another reason for its authenticity.
