عنوان فارسی بررسی داوری بیس‌بال (آخرین پیشنهاد) و امکان سنجی اعمال آن در سیستم حقوقی ایران
چکیده فارسی مقاله امروزه شیوه‌های جایگزین حل‌وفصل اختلافات نقش بسزایی در حل‌وفصل اختلافات ایفا می‌کنند. یکی از روش‌های نسبتاً نوظهور در این حوزه، داوری بیس‌بال است؛ این شیوه که خاستگاه آن به حل‌وفصل اختلافات میان بازیکنان و تیم‌های بیس‌بال در آمریکا بازمی‌گردد، فرایندی منحصربه فرد دارد؛ طرفین، پیشنهادهای نهایی خود را به صورت محرمانه و در پاکت‌های مهروموم‌شده به دیوان داوری ارائه می‌دهند و دیوان نیز موظف است بدون هیچ تغییری، یکی از این پیشنهادها را به عنوان حکم نهایی انتخاب کند. این روش، نظر به سادگی و سرعتش اهمیت زیادی پیدا کرده و حتی در حقوق عمومی و بین­الملل نیز قابل استفاده است. پژوهش حاضر تلاش دارد مفهوم و ماهیت داوری بیس‌بال را تبیین کرده و آن را با دیگر نهادهای مشابه مقایسه کند. همچنین، با بررسی سیر تحول تاریخی و موارد کاربرد آن در حقوق، امکان‌سنجی استفاده از آن را در سیستم حقوقی ایران مورد مطالعه قرار می‌دهد. دستاوردهای این پژوهش نشان می­دهد که داوری بیس‌بال شاخه‌ای از داوری است و از این رو تحت شمول مقررات داوری قرار می‌گیرد. در سیستم حقوقی ایران، این شیوه با توجه به عمومات قانون داوری تجاری بین‌المللی و مقررات داوری قانون آیین دادرسی مدنی، مشروعیت دارد و می‌تواند به عنوان یک روش خصوصی حل‌وفصل اختلافات مورد استفاده قرار گیرد.

عنوان انگلیسی An analysis of Baseball Arbitration (Final Offer) and the Feasibility of Its Application in the Iranian Legal System

 Today, alternative dispute resolution methods play a significant role in resolving disputes. One of the relatively new methods in this field is baseball arbitration; this method, which originated in the resolution of disputes between baseball players and teams in the United States, has a unique process; the parties submit their final proposals to the arbitration tribunal in confidence and in sealed envelopes, and the tribunal is obliged to select one of these proposals as the final award without any changes. This method has gained great importance due to its simplicity and speed and can even be used in public and international law. The present study attempts to explain the concept and nature of baseball arbitration and compare it with other similar institutions. It also studies the feasibility of using it in the Iranian legal system by examining its historical development and applications in law. The findings of this study show that baseball arbitration is a branch of arbitration and therefore falls under the scope of arbitration regulations. In the Iranian legal system, this method has legitimacy, considering the generalities of international commercial arbitration law and the arbitration regulations of the Civil Procedure Code, and can be used as a private method of dispute resolution.
