عنوان فارسی ابهام قانون مدنی در شرطیت "طهر غیر مواقعه" نسبت به صحت طلاق
چکیده فارسی مقاله در مقاله حاضر به این سوال پرداخته­ایم که مطابق مواد 1140 و 1141 قانون مدنی آیا نزدیکی در غیر طهر به صحت طلاقی که بلافاصله در طهر لاحق انشاء می‌شود اخلال وارد می‌کند یا خیر؟ چنانچه این طلاق باطل باشد و زن پس از طلاق، شوهر کند و مواقعه انجام شود؛ حتی اگر زوجین، جاهل به مسئله باشند علاوه بر کشف بطلان نکاح، این مرد و زن بر یکدیگر حرام ابدی خواهند شد. با بررسی اقوال و ادله­ی قائلین هر یک از این دو دیدگاه در میان فقها و حقوق‌دانان با محوریت مدلول مواد مربوط در قانون مدنی علی رغم عدم توجه بسیاری از ایشان به فرع مزبور؛ ثابت کرده‌ایم دیدگاهی که این نزدیکی را مخل می‌داند از پشتوانه‌ی فقهی قوی به ویژه نزد فقها و مراجع تقلید معاصر برخوردار است و شرط «استبرای از یک حیض» به جای «طهر غیر مواقعه» می‌تواند تأمین‌کننده‌ی مقصود باشد.

چکیده انگلیسی مقاله This article discuss about this question according to 1140 and 1141 Article in the Civil Code: Does the sexual intercourse disturbs the divorce while the pureness is posterior? If the divorce is void and one woman getting marry after that divorce, and the intercourse is occurred the marriage is void and they are eternally forbidden to each other even in the case of ignorance. Regarding the appreciations and the reasons of the supporters of these two standpoints among the jurists and the lawyers and their focus which is on the related codes in the Civil Code and regarding the inattention to this issue, it has been proved that the intercourse is disruptive and this view has many supporters especially among the jurists and contemporary Marja and the Istibra of the menstruation can supply our purpose.
