عنوان فارسی نقد و بررسی دلایل دیدگاه مشهور در باب نجاست فرزندان نابالغ کفار
چکیده فارسی مقاله یکی از موضوعاتی که کم و بیش در میان فقیهان مورد گفتگو بوده و مباحثی را نیز به دنبال داشته است، مسئله ناپاکی ذاتی فرزندان نابالغ کفار است. هرچند فقیهان سنی قائل به طهارت همه انسان‌ها، فارغ از نوع گرایش و باور آن‌ها شده‌اندکه به‌صورت طبیعی فرزندان کفار هم مشمول این قاعده کلّی قرار خواهند گرفت، امّا در مقابل، بیشتر فقیهان شیعی برآنند که نابالغان کفار، تابع پدران خویش بوده و همچون آنان ناپاک تلقی خواهند شد. این فقیهان در تأیید دیدگاه خود دلایلی را برپا داشته‌اند که در این مقاله همه این دلایل و مستندات مورد نقد و بررسی قرار گرفته و سُست بودن آن‌ها از جوانب مختلف نشان داده شده و در نهایت نظریّه پاکیزگی جسمانی کودکان کفار، چه در حوزه اهل کتاب و یا مشرکان مورد پذیرش قرار گرفته و شواهدی هم در تقویت این دیدگاه ارائه شده است.

چکیده انگلیسی مقاله One of the issues that has been more or less discussed among jurists and has followed by some discourses has been the innate impurity of the unbelievers’ underage children. The Sunni jurists believe in the cleanliness (ṭahārat) of human beings despite their type of tendencies and beliefs, which naturally includes the unbelievers’ children, too. In contrast, however, most of the Shī‘as believe that the unbelievers’ underage children follow their fathers and, like them, are considered as impure. In support to their viewpoints, these jurists have provided reasons that are all of them, as well as their evidences, critically reviewed and their feeble arguments are shown from different aspects and finally the theory of physical purity of the unbelievers’ children, whether in the field of the people of Scripture or the polytheists, is approved and some evidences have also been provided in this respect.
