عنوان فارسی تحلیل فقهی ـ حقوقی سرقفلی در قانون موجر و مستأجر مصوب سال ۱۳۷۶
چکیده فارسی مقاله هرچند در حقوق موضوعه ایران حق سرقفلی با عنوان "حق کسب و پیشه و یا تجارت" در قانون موجر و مستأجر سال 1339 شناسایی و در قانون موجر و مستأجر سال 1356 با عنوان "حق کسب یا پیشه یا تجارت" مورد حمایت بیشتری قرار گرفته است؛ اما صاحب نظران حقوق اسلامی شرایط شناسایی این حق را مغایر با قواعد فقه اسلامی، به ویژه اصل حرمت تصرف در مال غیر بدون رضایت مالک توصیف کرده و مشروعیت آن را مورد تردید قرار داده‌اند. از این رو، شورای نگهبان حق مزبور را فاقد عنوان شرعی اعلام کرد. بااین حال، به واسطه رواج این حق در رابطه موجر و مستأجر اماکن تجاری در عرف بازار، در قانون موجر ومستأجر سال 1376 عنوان یادشده به حق سرقفلی تغییر یافت و مشروعیت آن مورد توجه قرار گرفت؛ هرچند ابعاد حقوقی این حق و شرایط آن و مدیریت حقوقی روابط موجر و دارنده حق مورد بحث قرار نگرفته است.

عنوان انگلیسی Comparative Analysis of Commercial Goodwill of the Landlord and Tenant Act 1376 with the Jurisprudence Theories
چکیده انگلیسی مقاله Although in the Iranian statuary law the “commercial goodwill” is recognized in the landlord and tenant Act 1339 as “The right to business and profession and or the trade” and protected more in the landlord and tenant Act 1356 as “The right to business or profession or trade’, Islamic law experts’ renounced legitimacy of aforementioned right for the reason of non-compliance of this right’s conditions with the rules of Islamic law, specially, the principle of prohibition to take possession of other’s property without the owner’s consent. Therefore, the Guardian Council announced it as lacking the religious title. However, in the landlord and tenant Act 1376, the title of “The right to business or profession or trade” changed to the title of “commercial goodwill” and its legitimacy has apparently received attention; although legal aspects of this right and its conditions and the legal management of the relationships of the landlord and the possessor of the right have not undergone any discussions.
