عنوان فارسی حریم خصوصی فیزیکی افراد در آیینۀ فقه امامیه و حقوق ایران
چکیده فارسی مقاله حریم خصوصی، قلمرو و محدوده‌ای از اعمال و ویژگی‌های هر شخص است که برای عموم آشکار نیست و در وهلۀ نخست به فرد معینی اختصاص دارد و وی نیز تمایل به افشای آن ندارد. اشخاص هیچ گونه ورود و نظارت دیگران بر این فضا را برنمی‌تابند و نسبت به ورود غیر واکنش نشان می‌دهند. این مفهوم تاکنون در حقوق اسلامی و حقوق ایران به‌صورت مستقل بحث نشده است. قانونگذار ایرانی نیز با عنایت به بی‌سابقه بودن این موضوع در فقه و حقوق ایران، به‌صورت ناقصی تنها به شناسایی برخی مصادیق این حق پرداخته است. به حریم خصوصی فیزیکی به عنوان یکی از ابتدایی‌ترین مصادیق حقّ بر حریم خصوصی به‌صورت پراکنده‌ای در قوانین مختلف اشاره شده است. این مقاله، به بررسی وضعیت نحوۀ حمایت قانونگذار از حریم خصوصی فیزیکی اشخاص در فقه شیعه و حقوق موضوعۀ ایران و طرح حمایت از حریم خصوصی می‌پردازد.

چکیده انگلیسی مقاله Privacy is the realm and territory of every person's characteristics and behaviors which is not disclosed to the public and in the first stage, it is allocated to a particular person which he is not also inclined to disclose this privacy to others. People cannot tolerate any kind of others' entrance and supervision on this domain. They indicate reactions to the strangers' interference. This concept has not been discussed independently in Islamic and Iran's laws yet. Iranian legislators, considering the lack of past records about this structure in Iran's jurisprudence and laws, have just dealt with recognition of some evidences in an imperfect manner. As one of the most primitive evidences of the truth on privacy, physical privacy has been dealt with sporadically in different laws and regulations. The present study attempts to touch upon the conditions under which the legislator defends people's physical privacy in Shiite jurisprudence and the related laws in Iran and to discuss the protection bill of privacy.
