عنوان فارسی معاهدات ناظر بر همکاری‌های دولتی و نقش آن‌ها در انتقال فناوری
چکیده فارسی مقاله در این مقاله معاهدات ناظر بر همکاری‌های دولتی و نقش آن‌ها در جذب و انتقال فناوری مورد بررسی قرار می‌گیرد. این نوع معاهدات دارای ماهیتی کلی هستند و بنابراین بیانگر تعهدات مستقیم انتقال فناوری نیستند، بلکه زمینه و موجبات انتقال را از طریق ترتیبات دیگری مثل انعقاد قراردادهای لیسانس یا مشارکت و یا برگزاری مراکز تحقیق و توسعه مشترک فراهم می‌سازند. معاهدات مزبور از حیث هدف و موضوع تعهد، یکسان نیستند و به تبع، نقش آن‌ها در انتقال تکنولوژی متفاوت است. بر این اساس، باید میان دو نوع از معاهدات تفاوت قائل شد: معاهداتی که درخصوص انتقال، نقش غیرفعال و در نتیجه غیرمستقیم در انتقال تکنولوژی دارند و معاهداتی که نقشی فعال و مستقیم دارند.  در مورد گروه اول، وجود رابطه علی و معلولی میان آن‌ها و انتقال تکنولوژی مورد تردید قرار گرفته و این نتیجه حاصل شده که وجود مجموعه عواملی چون ثبات سیاسی و اقتصادی، قوانین و مقررات داخلی کشور میزبان، عوامل اقتصادی، هزینه‌های مورد نیاز برای سرمایه‌گذاری و دسترسی به منابع طبیعی، نقش بیش‌تری در جذب سرمایه و فناوری داشته‌اند تا صٍِرف وجود چنین معاهداتی. در مورد گروه دوم، یعنی معاهدات مستقیم و فعال، نخست نقش مثبت آن‌ها در زمینه‌های مختلف صنعتی توضیح داده شده و سپس مصادیق انتقال‌های صورت گرفته، مورد بررسی قرار گرفته است. با این حال، محدودیت‌هایی در فرایند انتقال مشاهده می‏گردد که هم عوامل خارجی و هم داخلی در این محدویت تأثیرگذار هستند. مشروط ساختن کمک‌های مالی و فنی به خریدهای اجباری و منوط کردن آن‌ها به خدشه‏ وارد نکردن به رقابت اقتصادی ـ صنعتی کشورهای کمک‌کننده همچنین سایر عوامل ذی‏ربط در این مجال مورد بررسی قرار خواهند گرفت.

چکیده انگلیسی مقاله This article tries to examine Cooperation Treaties and their impact on the transfer of technology. To this end, the study distinguished between two types of cooperation agreements: those which, because of their indirect effect on technology acquisition, are considered as passive, and those active ones, which have a direct impact on the transfer of technology. The first kind varied on their object and purpose. The most used and popular type of this group of arrangements were the bilateral and multilateral foreign investment agreements. Having examined them, we found that there was no causal relation between those and the transfer of technology. Instead, as available evidences suggested factors such as economic and political stability, national legislation and local market capacity were more powerful than the treaties in attracting foreign capital and technology. Yet, our conclusion was rather optimistic as we believed that such arrangements could have some positive impact although minor and time-consuming on the acquisition of technology. As to the second type of governmental cooperation, our finding was quite different. Accordingly, there wasa causal link between the two with some major limitations. Some of these limitations were germane to the conditions under which the donor country required the receiving one to apply (e.g. tied-aid) and some were related to the policy of the former in limiting such cooperation to the extent that it would not impair its competitive and comparative advantages at the regional and global level. The other obstacles were the failure of the receiving state in devoting the requisite resources to the acquisition of technology and the enhancement of its technological capacity. The lack of appropriate governancein the host country was also another impeding factor in attracting the necessary foreign technology.
