عنوان فارسی «حق» یا «ارزش» حیات؟ نکته ای منطقی در باب ادعای حق بر حیات
چکیده فارسی مقاله نظریه­ های موجهه حق این مفهوم را، مستقیم یا غیرمستقیم، بر اساس کرامت ذاتی انسان بنا می­ کنند. نظریه مبتنی بر اصلِ ماهویِ فلسفه ارزشِ ایمانوئل کانت قابل دفاع­ ترین نظریه در این حوزه می­ نماید. اصل یادشده بر غایت بودن حیات انسانی یا، به تعبیری سلبی، بر منع برخورد ابزاری با انسان دلالت می­ کند. لازمه این اصل "برابری ارزشی" انسان­ هاست. برابری ارزشی به نوبه خود مقتضی حمایت از برخی ادعاهای فردی و تضمین آنهاست. این ادعاها در تاریخ اندیشه و عمل انسان به «حق» ("حق­ داشتن" و نه "حق­ بودن") شهرت یافته ­اند. پیداست «ارزش» حیات انسان مبنای «حق» اوست. پرسش اکنون این است که آیا منطقاً می­ توان از «دلیل» (ارزش حیات انسان) با عنوان «مدعا» (حقوق بنیادین انسان) یاد کرد؟ این پرسش به حق­ مصونیت ­ها در برابر حبس ناموجه، شکنجه، مجازات اعدام، برده­ داری یا ضرب و جرح یا به حق ­ادعاها بر غذا، پوشاک، سرپناه یا درمان باز نمی­ گردد، بل به بنیاد این حق ­ها روی دارد.

عنوان انگلیسی Right to or Value of Life? A Logical Point on the Claim of Right to Life
چکیده انگلیسی مقاله Justificatory theories of rights ground, directly or indirectly, the concept of rights on human dignity. Here, the theory that relies on substantive principle of Kantian philosophy of value seems the most justifiable one. This principle takes human life as an end in itself or, in a negative way, prohibits treating human beings as a means to an end. The said principle implies “normative equality” of human beings. Normative equality in its turn requires protection and guarantee of certain claims by individuals. In the history of human thought and practice, these claims are known as “rights” (“having rights” as against “being rights”). It is clear that “value” of human life is a reason, if not the reason, for their “rights”. The question is now whether or not one is logically allowed to talk about “reason” (value of human life) under the title of “claim”. This question, of course, does not take issue with immunity-rights against unjustified detention, torture, capital punishment, slavery or injury or with claim-rights to food, clothes, shelter or medical treatment. It does deal with their basis though.
