عنوان فارسی مطالعه تطبیقی مفهوم و ماهیت حق انتساب اثر فکری در حقوق کشورها
چکیده فارسی مقاله « حق انتساب اثر به پدیدآورنده آن» یکی از مهم‌ترین جنبه ‌ های حقوق اخلاقی یا معنوی پدیدآورندگان آثار فکری است که در اغلب زیر شاخه­های حقوق مالکیت فکری مطرح بوده و مورد حمایت قوانین بین‌المللی نظیر کنوانسیون برن و قانون­گذاران بسیاری از کشورها قرار گرفته است. با وجود این، نسبت به ابعاد مفهومی و ماهیتی و قلمرو آن، بین نظام‌های مختلف حقوقی ابهامات و اختلافات زیادی به چشم می‌خورد. پژوهش حاضر بعد از بررسی موضوعات مربوط به چگونگی نام‌گذاری این حق در قوانین کشورها و تاریخچه آن، با تفکیک ابعاد سلبی (همچون حق ممانعت، حق گسستگی و حق انکار) و اثباتی(نظیر حق افشای نام واقعی، مستعار و بی نام) این حق، جنبه ‌ های مختلف هر کدام از آن‌ها را به تفصیل مورد بررسی تطبیقی قرار داده است. به علاوه مصادیق حق مزبور و استثنائات آن در قوانین کشورها و نیز قوانین حقوق مالکیت فکری ایران در این تحقیق به دقت موشکافی شده است.

عنوان انگلیسی »Comparative Study on the Concept and Nature of the Attribution Right in the Law of Countries
چکیده انگلیسی مقاله “The Attribution Right” of the author is one of the most important aspects of the authors’ Moral Rights that exist in the most branches (either literary and artistic property or industrial property) of the Intellectual Property Rights and is protected by international laws like Berne Convention and many national Acts. However, there are many ambiguities about the scope and conceptual and natural respect of it between various legal systems. The current comparative research has surveyed, following discussion its terminology and history, diverse dimensions of the positive and negative of this right, like to have the author's name or his pseudonym mentioned in connection with his work and the Dissociation Right and Disavowal Right. Furthermore, all instances of this right in the national laws especially in Iran Intellectual Property Laws (either Literary and Artistic Property or Industrial Property Laws) have been dissected in this survey.
