عنوان فارسی تخریب و غارت میراث فرهنگی در دوران تهاجم و اشغال عراق از منظر حقوق بین‌الملل کیفری
چکیده فارسی مقاله اشغال عراق در 2003، پیامدهای انسانی و اجتماعی گوناگونی ازجمله تخریب و غارت اموال فرهنگی این کشور بجای گذاشت. مقاله حاضر در پی پاسخ به این سؤال است که آیا از منظر حقوق بین‌الملل کیفری، نیروهای آمریکایی در این زمینه مرتکب نقض مقررات بین‌المللی شده‌اند؟ از آنجا که مطابق مقررات بین‌المللی، حفاظت از میراث فرهنگی کشور اشغال شده به عهده قدرت اشغالگر است و مستندات بسیاری نیز نشانگر دخالت مستقیم نیروهای آمریکایی در تخریب و غارت گسترده میراث فرهنگی بین‌النهرین است، به این نتیجه رسیده‌ایم که اگرچه دولت   ایالات متحده آمریکا در 12 مارس 2009 به کنوانسیون 1954 لاهه مربوط به حفاظت از میراث فرهنگی پیوسته است، اما به این دلیل که مقررات بین‌المللی مربوط به حفاظت از میراث فرهنگی جزئی از حقوق بین‌الملل عرفی بشمار می‌رود، نیروهای آمریکایی، مسئولین و دولت آمریکا در این زمینه مسئولیت دارند و باید در مراجع صالح قضایی پاسخگو باشند.

چکیده انگلیسی مقاله The invasion of Iraq in 2003, has left various social and human consequences,  including destruction and looting the Iraq cultural heritage. This article seeks to answer the question of whether from the perspective of international criminal law the US forces violated international rules in this area. Since in accordance with the international regulations, the occupying power is responsible for protecting cultural heritage of the occupied country, and many documents which indicate the direct involvement of the US troops and in destroying and looting the cultural heritage in Mesopotamia, we can come to this conclusion that Although the United States of America Joined to the 1954 Hague Convention relating to the protection of cultural heritage on 12 March 2009, Because international rules relating to the protection of cultural heritage is considered part of customary international law, US forces and officials in America are responsible for  destruction and looting of Iraq's cultural heritage during the occupation of the country and should be held accountable and go to trial.
